Reforma juvenil: el III conveni fixa 1.642,5 hores i puja els sous

The Official Gazette of the Balearic Islands publishes in issue 137, corresponding to October 27, 2026, the III Collective Agreement for the youth reform and child protection sector of the Balearic Islands, after the Department of Labor, Public Service and Social Dialogue ordered its registration and deposit in the regional registry of agreements through Resolution 10720. The text, signed by the Negotiating Commission on May 29, 2026, and modified by agreement on October 6, 2026, establishes the minimum labor conditions for the entire sector in the archipelago between January 1, 2027, and December 31, 2030.

The processing is detailed in the resolution’s file: the representative of the Negotiating Commission, Maria Cutillas Belmonte, requested the registration, deposit, and publication of the agreement on June 26, 2026. The resolution was electronically signed on October 23, 2026, by the Director General of Labor and Occupational Health, María de la Luz Moreno Romero, by delegation of the counselor, and is framed within articles 90.2 and 90.3 of the Workers’ Statute (Royal Legislative Decree 2/2015), Royal Decree 713/2010 on the registration and deposit of agreements, and article 45 of Law 39/2015. The new text “annuls, repeals, and replaces” the II Collective Agreement of the sector.

A scope covering the entire protection and reform network

The agreement applies to all companies, entities, centers, programs, and services linked to the regulations on the legal protection of minors and the criminal responsibility of minors, and has application priority over other concurrent agreements when the main activity is the care of minors in situations of risk or abandonment. Included services include:

  • Detention centers for juvenile offenders in closed, semi-open, open, and therapeutic regimes.
  • Day centers for the application of judicial measures and open-medium programs.
  • Reception and first-welcome centers, residential care centers, and care centers for unaccompanied foreign minors.
  • Functional homes, emancipation flats, and transition flats to adult life.
  • Family foster care programs, training for adoptive families, and family meeting points.
  • Socio-labor insertion programs and centers for minors and youth in situations of risk.

Excluded from the text are civil servants and labor personnel of public administrations, social volunteers, professionals collaborating via service leases, and interned minors with a labor relationship in productive workshops.

Working day of 1,642.5 hours and 25 vacation days

Working time conditions are fixed for all years of validity:

  • Maximum annual total of 1,642.5 hours of effective work, equivalent to 37.5 hours per week.
  • Irregular distribution of up to 5% of the annual working day, with a maximum of 45 hours per week in these cases.
  • Possibility of adapting the split shift to a continuous shift between June 23 and September 15, as well as during the Easter and Christmas periods.
  • Minimum continuous weekly rest of 48 hours and 12 hours between shifts, with a 20-minute break for every 7 hours and 30 minutes.
  • 25 working days of annual vacation, with a guaranteed minimum of 10 continuous working days between June 1 and September 30.

Four professional groups and salary tables until 2030

Annex 1 contains the salary tables for the four fiscal years. The annual base salary increases, between 2027 and 2030, from 29,851.48 to 33,578.86 euros for group 1; from 23,580.17 to 26,524.48 for group 2; from 22,923.12 to 25,785.39 for group 3; and from 22,226.57 to 25,001.87 for group 4. Other notable amounts:

  • Insularity bonus: 1,372.10 euros annually in Mallorca and Menorca and 2,744.74 in Ibiza and Formentera in 2027, reaching 1,543.43 and 3,087.46 in 2030.
  • Seniority: 35 euros per month per three-year period, with the alternative of one additional vacation day per three-year period, up to a maximum of eight.
  • Night shifts and holidays: 25% compensation on base salary and specific supplement, which rises to 100% of the ordinary hour on December 25 and January 1.
  • Broker supplement: 1,755.97 euros annually in 2027, up to 1,975.22 in 2030.
  • Single compensation of 1,800 euros in case of mandatory permanent transfer, with 600 euros initially and the remainder prorated over twelve months.

The base salary is received in fourteen payments and there are two extraordinary bonuses, which must be made effective before June 30 and December 20.

Joint Commission and new monitoring bodies

The agreement creates a Joint Commission as a body for interpretation, conciliation, and surveillance, with recourse to the Arbitration and Mediation Tribunal of the Balearic Islands (TAMIB) in case of disagreement. It also provides for a sectoral joint body for the promotion of health and safety at work, in accordance with the Spanish Strategy for Health and Safety at Work 2023-2027, and urges the creation of tripartite tables with public administrations to set ratios between users and workers. The first additional provision commits the parties to continue negotiating the improvement of seniority and salary increases higher than those agreed upon for the years 2028, 2029, and 2030.

The relevance of the text is twofold: for the first time, the sector has a homogeneous framework until 2030 for the entire Balearic territory, and it does so with a reduction in working hours, a minimum number of vacation days, and salary tables closed year by year that directly affect the staff of child protection and reform centers, services that are financed with public funds and which must reflect these conditions in the procurement specifications.
