Civil Protection: Lombardy Region takes over post-flood management in Brescia
Por FactBox Admin

The Lombardy Region succeeds the Delegated Commissioner in the ordinary management of interventions aimed at overcoming the critical situation that arose following the exceptional weather events of October 20 - November 10, 2023, in the territory of the province of Brescia. This is mandated by Ordinance no. 1215 of September 17, 2026, signed by the Head of the Department of Civil Protection, Ciciliano, published in the Official Gazette of the Italian Republic, General Series no. 231 of October 5, 2026 (ref. 26A05202). The measure is immediately executive.
The text stems from Article 26 of the Legislative Decree of January 2, 2018, no. 1 and closes the commissarial phase opened by Ordinance no. 1083 of May 9, 2024 (“First urgent civil protection interventions”), integrated by Ordinance no. 1099 of September 13, 2024. The state of emergency had been declared by resolution of the Council of Ministers on April 15, 2024, for twelve months and extended for a further twelve months by resolution on April 9, 2025. The resolution of the Council of Ministers of January 14, 2025, had integrated the allocation of 15,800,000.00 euros.
The new responsible entity
The pro tempore Director General of the Directorate competent in civil protection matters of the Lombardy Region is identified as the entity responsible for the completion initiatives. They operate free of charge and make use of regional organizational structures, entities already identified by the Delegated Commissioner and, if necessary, further entities based on a specific agreement, without new or increased burdens on public finances.
The assigned tasks are:
- completion of interventions fully funded and included in the approved Plans;
- disbursement of immediate support and immediate recovery grants referred to in Article 4 of Ordinance no. 1083/2024;
- survey and verification of pending procedures and legal relationships;
- final transfer of completed works to the ordinarily competent entities.
For a further six months from the date of entry into force, the responsible entity and the implementing entities may make use of the derogatory provisions regarding the awarding of public works and the acquisition of goods and services, as well as the rescheduling of the terms indicated in Articles 3, 5, and 6 of Ordinance no. 1083/2024.
Special accounting until April 14, 2028
The resources remain in special accounting no. 6447, opened pursuant to Ordinance no. 1083/2024, which is registered to the new responsible entity until April 14, 2028. Upon expiration, the responsible entity shall proceed with the closure of the accounting and the transfer of any residual resources.
Resources allocated to interventions not yet completed are transferred to the budget of the Lombardy Region, which shall provide for their completion. Excess sums are paid into a specific revenue chapter of the State budget and allocated to the National Emergency Fund or to the forecast statements of the administrations concerned; those coming from entities other than the State return to the budgets of the same.
Transparency and reporting obligations
The measure establishes a series of requirements:
- within sixty days of publication in the Official Gazette, the delegated Commissioner shall send a report to the Department of Civil Protection on the measures adopted, completed interventions, and ongoing activities with the relative economic framework;
- the responsible party shall report on a semi-annual basis on the state of implementation, even after the closure of the special accounting;
- it is possible to revoke interventions not awarded within six months from the expiration of the state of emergency, with the reuse of the sums for interventions connected to overcoming the emergency;
- publicity obligations for transparency purposes and requirements regarding the prevention of corruption are ensured;
- the reporting obligations referred to in Article 27, paragraph 4, of Legislative Decree no. 1 of 2018 remain in effect.
The transition to the ordinary regime means that the management of the Brescia interventions no longer depends on an extraordinary commissioner but on the regional administration, with resources earmarked until 2028 and semi-annual audits. The same Gazette publishes twin ordinances no. 1216 for Emilia-Romagna and no. 1217 for Veneto, confirming a coordinated transition on a national scale.
