Ports IB grants the concession for the Cala Rajada port restaurant

The Board of Directors of Ports de les Illes Balears agreed, in the session of September 10, 2026, to grant the administrative concession for the occupation and operation of a premises intended for a restaurant in the service area of the port of Cala Rajada, in the municipality of Capdepera. The agreement, signed by Vice President Antonio Mercant Morato on September 17, is published in the Official Gazette of the Balearic Islands (BOIB) no. 117, of September 19, 2026, edict 9349, and awards the operation to LIMPIEZAS GENERALES DE BALEARES, S.L. for a term of fifteen years.

The file, referenced as exp. 510/2026, stems from the agreement of the Board of Directors of December 17, 2025, which ordered the start of the procedure through a public tender. On January 27, 2026, the call for applications and the specifications and technical prescriptions were approved; the tender announcement was published on January 30 on the Public Sector Procurement Platform (PLACE) and on February 17 in BOIB no. 22.

Competence over the public port domain of ports not declared of general interest corresponds to the Autonomous Community, according to article 30.5 of the Statute of Autonomy of the Balearic Islands and article 3 of Law 10/2005, on ports of the Balearic Islands. Article 59 of this regulation requires authorization or concession for uses with special circumstances of exclusivity, intensity, danger, or profitability, and article 79 of the Law and article 78 of Decree 11/2011 enable Ports de les Illes Balears to call for tenders. The resolution of the tender and the granting of the concession correspond to the Board of Directors, by virtue of article 33.1 d of the Law, article 11.1 f of the Statutes approved by Decree 134/2005, and articles 81 and 82 of Decree 11/2011.

Two offers and one prior award

Within the period granted for the submission of offers, two proposals were received:

• BALADRE DE MALLORCA, S.L.U.
• LIMPIEZAS GENERALES DE BALEARES, S.L.

The Evaluation Commission proposed the award to the second, and by Resolution of the vice president of May 12, 2026, the tender was awarded with an annual fee of €92,640 plus VAT. Notification was made on May 13, and on May 29, the interested party submitted the required documentation.

Conditions of the concession

The agreement grants the administrative concession with the following characteristics:

• Surface area of the premises: 486.37 m²
• Annual fee: €92,640 + VAT
• Term: fifteen years, without possibility of extension
• Automatic extension until October 31 of the calendar year, only in the event that the concession ends before this date

Project, works, and reversion of assets

On June 16, 2026, the successful bidder was required to provide the final project, and on July 8, they submitted the Basic project and execution of distribution and adaptation of a restaurant in an existing building, drafted in June 2026 by the architect Miquel Ochogavia Far, and the Project of activities and installations of a restaurant with a request for an activity license, signed in June 2026 by the electrical technical engineer Francisco Javier Vela Rodríguez. On August 11, the technician from the Operations Area issued a favorable report on the projects with a series of conditions, and the managing director technically approved the basic project.

The agreement definitively approves the project and establishes that the works be executed in accordance with what was presented, with a maximum deadline until March 2027. The photovoltaic installation must be executed on an aluminum metallic structure anchored to the flat roof with counterweights, without piercing the waterproofing membrane, so as not to compromise the building’s warranty; any loss of watertightness will be the responsibility of the concessionaire. All works and fixed installations will become part of the assets reverted at the end of the concession, and the concessionaire must notify Ports IB in writing of the appointment of the technical director of the works and the start thereof.

Publication and means of appeal

The agreement orders its publication in the PLACE, the BOIB, and on the Ports de les Illes Balears website, and its notification to the interested party. Against the agreement, which exhausts the administrative route, the following may be filed:

• Optional appeal for reversal before the Board of Directors of Ports de les Illes Balears, within a period of one month from the day following the notification
• Contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Palma, within a period of two months from the day following the notification

The concession ensures the continuity of the catering service in the service area of the port of Cala Rajada for fifteen years and concludes a file opened in December 2025, with an investment in the renovation of the existing building that must be completed by March 2027. For the hospitality sector of Capdepera, the operation sets an annual fee of 92,640 euros plus VAT and incorporates a photovoltaic installation, a relevant element in a tourist port in East Mallorca.
