Olot submits the addendum to the agreement with INCASÒL for public consultation

Por FactBox Admin

Olot sotmet a informació pública l'addenda del conveni amb INCASÒL

The Olot City Council approved on September 24, 2026, the addendum to the agreement that the corporation signed with the Catalan Institute of Soil (INCASÒL) on February 21, 2025, to expropriate by mutual agreement lands owned by this body and pay for them through the future exchange of resulting, fully urbanized plots from the PA 09.04 C/Sant Cristòfol Pont de Santa Magdalena. The Urban Planning Area of the Olot City Council is now submitting this addendum for public consultation for one month, starting from the day after the publication of the announcement in the Official Gazette of the Province of Girona, which takes place on October 27, 2026 (edict 9146, CVE BOP-2026_0_207_9146).

The procedure is carried out by legal mandate: Article 104 of Legislative Decree 1/2010, of August 3, which approves the Recast Text of the Urban Planning Law of Catalonia (TRLUC), requires urban planning agreements to be submitted for public consultation before they take full effect, so that any interested party may submit allegations and claims. The agreement is therefore not a closed decision, but rather the prior exhibition phase that the legal system reserves for this type of urban management instrument.

The core of the operation is a singular expropriation: the City Council does not pay in cash for the INCASÒL lands, but will instead deliver urbanized plots from the same sector in the future. The approved document frames this formula within Article 24 of the Compulsory Expropriation Law, which regulates expropriation by mutual agreement, in relation to Article 109 of Legislative Decree 1/2010 (TRLUC).

A 2025 agreement that is now being completed

The original agreement was signed on February 21, 2025, between the Catalan Institute of Soil and the Olot City Council, and established the expropriation by mutual agreement of the INCASÒL lands located within the scope of the PA 09.04 C/Sant Cristòfol Pont de Santa Magdalena. The addendum approved by the Plenary in September 2026 completes and adjusts that pact without altering its essence: the fair price continues to be satisfied with urbanized land and not with cash.

The administrative sequence is as follows:

  • February 21, 2025: signing of the agreement between INCASÒL and the Olot City Council.
  • September 24, 2026: the Corporation’s Plenary approves the addendum to the agreement.
  • October 20, 2026: date of the edict signed by the mayor, Agustí Arbós Torrent.
  • October 27, 2026: publication in the BOP of Girona no. 207, edict 9146.
  • October 28 to November 27, 2026: one-month period, counted from the day after publication, to submit allegations and claims.

One month to appeal

The edict sets a deadline of one month starting from the day after its publication in the provincial bulletin. During this period, any person or entity that considers itself affected may submit allegations and claims against the content of the addendum. The text does not specify amounts, areas, or material deadlines for the exchange; therefore, the complete documentation must be consulted through the municipal file.

Who is affected

The exchange links the result of the expropriation with the execution of the sector: the council will only be able to deliver the plots to INCASÒL once they are effectively urbanized, according to the wording of the agreement. This means that owners, developers, and rights holders within the scope of PA 09.04 have a direct interest in the schedule and conditions of the reparceling.

For the residents of the Sant Cristòfol and Pont de Santa Magdalena areas, this procedure is the formal way to review an agreement that conditions the future planning of a piece of urban land pending development. For legal and real estate operators, the one-month deadline is the only window to correct or challenge the conditions of the exchange before the addendum becomes final.
