Murcia aprueba el plan especial Torre Norte de 21 plantas

The Plenary of the Murcia City Council, in a session held on September 24, 2026, definitively approved the “Torre Norte” Special Urban Planning Plan project referring to plot 17 of block Ñ of Execution Unit III of Partial Plan CR-6, under the Provision Action regime. The agreement is published in the Official Gazette of the Region of Murcia (BORM) number 244, dated October 22, 2026, section IV. Local Administration, pages 25598 to 25607, with the official reference A-221026-5155. The full text of the regulatory ordinances and the planning and management sheet accompany the municipal resolution.

A change of use from offices to housing

The file, processed under number 2023/00402/000180, transforms the use of the plot: where office use was planned, residential use is now implemented, which requires the establishment of a Provision Action in accordance with article 7.1.b of the TRLS/15 and article 193.1 of the LOTURM. The plot corresponds to partial plot number 17 of block Ñ7 of Action Unit III of Partial Plan CR-6, definitively approved on 09/13/99, and is already urbanized, with a reception act by the Civil Engineering Service dated 07/23/2014.

The approved parameters are as follows:

  • Scope of the action: 7,222.13 m²s, with a net buildable land coefficient of 0.2333 m²s/m²s.
  • Total buildability: 12,966.00 m²t, of which 11,280.79 m²t are residential and 1,685.21 m²t are tertiary.
  • Height on plot Ñ: 79.60 meters and 21 floors plus a penthouse set back 3 meters, with telecommunications antennas up to 90 meters.
  • General systems: 1,466.50 m²s of green areas and 2,256.16 m²s of equipment, up to 3,722.66 m²s.
  • Economic compensation of equivalent value: 2,282,938.81 euros.

Collective housing, tertiary, and public-use open space

The ordinances transfer to the scope the determinations of Partial Plan CR-6 for collective residential and isolated tertiary-commercial use, adapted to the special plan. Ordinance 1 admits all types of housing, allows global Service use on the ground and first floors, and prohibits industrial use in all its categories; the three already constructed basements cover the standard of one space per dwelling or per 100 m² of commercial space, and two spaces for dwellings over 150 m². Ordinance 2, for isolated tertiary use, sets a maximum height of 11 meters and three floors, a minimum separation of 5 meters from roads, and 100% plot occupancy.

Ordinance 3 regulates the private open space designated with the initials “RO” of the Murcia PGOU: of the area classified as RO, 2,256.16 m² shall be for public access and enjoyment, may not be fenced, and the enclosures of the rest of the perimeter must be permeable with a maximum height of 2.5 meters. At least 50% of this area shall have vegetation treatment with native species of low water consumption, without artificial lawns. Ordinance 4 also imposes sustainability measures: green roofs, elements that facilitate bird nesting, electric vehicle charging points, and parking for bicycles and scooters.

The flood risk constraint

The plan recognizes that the plot is partially affected by flood risk for a 500-year return period and totally by the Preferential Flow Zone, therefore reproducing the restrictions of articles 9 ter, 9 quáter, and 14 bis of the Public Hydraulic Domain Regulations. Building projects must apply the Technical Instruction for the application of the High Flood Risk Regime of the Murcia City Council and the municipal decrees of April 8, 2022, April 21, 2022, and October 4, 2024.

Obligations include guaranteeing the watertightness of basements for the 500-year flood, installing floodgates and bilge pumps, providing vents and evacuation routes above the flood level, and providing, before the start of works, a certificate from the Property Registry with the annotation that the construction is in a preferential flow zone. The developer must notify the basin authority of any substantial modification in water demand and, if connection to the low-pressure network is not possible, the Mancomunidad de Canales del Taibilla will establish the new intake with an autonomy tank for seven days.

Publication, deadlines, and appeals

The municipal resolution, the full content of the Special Plan including its environmental aspects, the Environmental Monitoring Program, and the checklist are available to the public at the municipal electronic address for urban planning information. The agreement is signed by the Secretary General of the Plenary, Antonio Marín Pérez, dated October 14, 2026.

As this is an administrative provision of a general nature, no administrative appeal is possible according to article 112.3 of Law 39/2015, meaning a contentious-administrative appeal may be filed directly before the Contentious-Administrative Chamber of the High Court of Justice of Murcia within a period of two months. The processing is supported by articles 132, 159, 182.7, and 193 of Law 13/2015, of March 30, on Territorial and Urban Planning of the Region of Murcia, and article 51 of Law 21/2013 on Environmental Assessment.

The approval closes a file opened in 2023 and clears the development of one of the pending plots of the CR-6, but transfers a set of technical obligations regarding flood risk to developers and future residents, which will condition the building project. For the owners of block Ñ and the surrounding neighbors, the change of use consolidates the residential transformation of the area and opens a two-month window to challenge the plan in court.
