Manlleu aprova l'expropiació de terrenys de La Salle per al vial SX

The Manlleu City Council has definitively approved the list of assets and rights to be expropriated to allocate the land to the urban communications system (road system SX) of the Municipal Urban Planning Plan (POUM). The agreement, adopted by the plenary session in the ordinary meeting of July 28, 2026, affects a portion of the La Salle school property on Enric Delaris Street and is published in the Official Gazette of the Province of Barcelona on October 6, 2026, with the reference CVE 202610145826.

The municipal plenary approved the list of assets and rights and declared the necessity to occupy them, within file 212468W. The action is framed under article 110.1.b) of the Revised Text of the Urban Planning Law (TRLU), which legitimizes expropriation for the execution of public urban systems not included in areas subject to the land readjustment system.

The planning that gives rise to the action is the POUM of Manlleu, definitively approved by the Territorial Urban Planning Commission of Central Catalonia in the sessions of January 18 and April 19, 2023, and published in DOGC number 8945, dated June 27, 2023. The POUM classifies the property as urban land and designates it as an urban communications system, urban road network (SX2).

The approved list includes a single property, number 1, located at 66 Enric Delaris Street, in the portion of the chamfer with Sant Antoni Street and Passeig del Ter. The official data are:

The affected part is located in front of Passeig del Ter and includes a perimeter fence delimiting a small interior courtyard and part of the school complex’s sports pavilion, currently in use and in a normal state of conservation. The affected portion will be segregated from the parent property to regularize the alignments and complete the road network in execution of the provisions of the current planning.

Fair price of 176,689.19 euros by agreement

The city council has accepted the agreement formulated by the owning congregation and has fixed the fair price at 176,689.19 euros, as a global and lump-sum amount for all concepts, including any damage, loss, or compensation derived from the expropriation. The valuation is broken down as follows:

  • Land value (including a 5% affection premium): €33,156.63
  • Value of affected real estate assets: €44,532.06
  • Conditioning expenses for the affected properties: €99,000.50
  • Total: €176,689.19

Payment will be charged to budget application 0311 151 60000000 of the current municipal budget, via transfer to an account owned by the congregation. Payment must be prior to or simultaneous with the administrative occupation, and the municipal services will summon the owner to formalize the agreement, payment, and occupation in a single act. The mayor, Arnau Rovira Martínez, is authorized to sign the mutual agreement act and the necessary documents.

Publication, deadlines and appeals

The agreements are final in the administrative route. Interested parties may file:

  • An optional appeal for reversal (recurso de reposición) before the body that adopted them, within one month from the day following the last mandatory publication.
  • A contentious-administrative appeal before the High Court of Justice of Catalonia, within two months from the day following the last mandatory publication.

The agreements are published in the Official Gazette of the Province of Barcelona, on the notice board of the municipal electronic office, and in the newspaper El Punt Avui, and are notified in full to the expropriated owner and their representation.

The operation will allow for the completion of the urban road network planned by the POUM in this sector of Manlleu and the regularization of the alignments of the Ter promenade, an action that directly affects the La Salle school complex and entails the reduction of the courtyard and part of the sports pavilion currently in use.
