Por FactBox Admin

The executive councillor for Territory, Mobility and Infrastructure of the Insular Council of Mallorca, Fernando Rubio Aguiló, resolved on October 28, 2026, the final approval of the “Construction project for the conditioning of the false tunnel section and improvement of the Sa Mola tunnel facilities”, with the key 21-08.0-ML. The decision is published in the Official Gazette of the Balearic Islands (BOIB) no. 139, of October 31, 2026, within Section III (other provisions and administrative acts), with announcement number 10935. The budget for the Administration’s knowledge is 7,526,404.12 euros.
A project from July 2026 signed by seven technicians
The document was signed in July 2026 by Ignacio López Bonmatí, civil engineer from the consulting company TPF GETINSA EUROESTUDIOS, S.L., and bears the signatures of the project directors:
- Jairo Fernández Herrera, civil engineer.
- Veronica Burriel Tur, technical engineer of public works.
- Xisco Salvá Garau, telematics installations engineer.
- Antònia Gonzalez García, industrial engineer.
The approval corresponds to Laura Montaner Berges, head of the Planning and Projects Service of the Insular Directorate of Infrastructure and ITV. The project consists of five documents distributed across nine PDF files: report and annexes, plans, technical specifications, budget, and health and safety study.
7.5 million and three distinct items
The budget is broken down into three concepts, including 10% VAT:
- Base tender budget (PBL): 7,260,594.29 euros.
- Promotion and protection of historical and artistic heritage: 108,908.91 euros.
- Waste management: 156,900.92 euros.
The resolution is based on Law 5/1990, of May 24, on roads of the Autonomous Community of the Balearic Islands, Law 16/2001, of December 14, and article 70.15 of the Statute of Autonomy. The competence to approve the project derives from article 231 of Law 9/2017, on public sector contracts, and from the delegation agreed upon by the Executive Council on May 28, 2025 (BOIB no. 69, of May 31, 2025), which empowers executive councillors provided that the project does not involve compulsory expropriation.
Safety, affected services and traffic
The processing has included several mandatory reports. On September 25, 2026, supervision report 2026-09_PC was issued, favorable to the approval, which rules out impacts on private plots and concludes that the public information process is not mandatory according to article 19 of Law 5/1990. On July 31, 2026, the opinion of the tunnel safety manager was received, in accordance with Royal Decree 635/2006, which considers the project to be in compliance with the regulation.
Regarding the affected services, the project foresees crossings with:
- A municipal ownership service.
- An underground medium-voltage power line belonging to Vall de Sóller Energia, S.L.U., part of the El Gas group.
- Telephony lines belonging to Telefònica.
The hearing with the companies opened on July 21, 2026; Vall de Sóller Energia expressed its agreement on October 5, 2026, while Telefònica did not respond. It is also noted that in December 2025, the Mallorca Fire Service was consulted regarding network requirements to guarantee operability in case of fire, and that on September 16, 2026, the Sóller City Council authorized, under registration RGE no. 97204/2026, the traffic diversions affecting sections of its local road network. The action is not subject to an environmental impact assessment according to Legislative Decree 1/2020.
Next steps and appeal
Once the works have been executed, the authorization for the commissioning of the tunnel must be processed, and the operation manual, currently being drafted by the security team, must be updated during the work. Against the resolution, which does not exhaust the administrative route, an appeal for reversal may be filed within one month before the executive councillor or the Executive Council, and subsequently a contentious-administrative appeal within two months.
Final approval is the indispensable previous step to tender a work that directly affects mobility in the Sóller area and the safety of a road infrastructure in service. For users of the Sa Mola tunnel, the project entails conditioning the section of the false tunnel and renovating the facilities, meaning less risk and greater operational guarantees in case of an incident.
