Leganés approves the special plan that orders two dwellings in San Nicasio
Por FactBox Admin

The Leganés City Council has definitively approved the Special Plan for plot RU (A) of block 2 of the San Nicasio Extension Partial Plan, a detailed planning instrument that establishes the shape of buildable volumes and alignments on urban land. The agreement was adopted by the Municipal Plenary in the session of February 26, 2026, and is now published in the Official Gazette of the Community of Madrid (BOCM) number 266, of November 5, 2026, with the official reference BOCM-20261105-69.
An adjustment to align the ordinance with the ramp and buildability
The plan does not change the use or density of the area, but rather alters alignments, setbacks, and buildable depth “without increasing buildability.” The report justifies the intervention based on a dual problem detected by the developers: the strict application of the Single-Family Housing Residential Ordinance of the Partial Plan 1 San Nicasio Extension prevents the execution of the access ramp for plot number 16 without exceeding the permitted cornice height, and also prevents the maximum buildability of that property from being exhausted, which would leave building rights unconsolidated.
The reference framework is the General Urban Development Plan (PGOU) of Leganés and the aforementioned partial plan, whose structuring determinations are respected. The full publication of the regulatory documentation—planning report, urban regulations, and economic study—is carried out in application of Article 70.2 of Law 7/1985, of April 2, Regulating the Bases of Local Regime, following the deposit of the document in the administrative registry of the competent department, in accordance with Article 66 of Law 9/2001, of July 17, on Land of the Community of Madrid.
Two self-promoters and 680,000 euros for two semi-detached houses
The action will be executed under a private promotion regime by its own promoters, who will build two semi-detached single-family homes for their own use and not for sale to third parties. The promoters at 50% are:
- María Isabel Bravo Álvaro and Daniel Jiménez Llorente, owners of plot number 14.
- Laura Cezón Muñoz and Mario Rodríguez Muñoz, owners of plot number 16.
The economic-financial study estimates the total investment at 680,000 euros for both homes, including construction, technical, administrative, and financial expenses. The plan is developed in a single stage, with an execution period of two years from the definitive approval, and does not require the intervention of local treasuries: the infrastructure and services already exist and their maintenance will not be affected.
No changes to roads, networks, or heritage
The plan limits its effects to the interior of the plots. The documentation maintains that it does not alter the road structure, the accesses, the gradients, or the typical section of Zurbarán Street, and that the surrounding sanitation, water, electricity, and public lighting networks remain intact. There is also no impact on the built heritage, and the urban scene will improve with the landscaping planned for the rear boundary of both plots.
Since no works are being executed, prior authorization from the Cultural Heritage of the Community of Madrid is not required, although future buildings must comply with Law 8/2023, of March 30, on Cultural Heritage. The document also invokes the fourth additional provision of Law 11/2022, of December 21 (known as the “Omnibus Law”), which excludes gender and LGBTI impact reports from urban planning, and recalls that the Law 8/1993 on accessibility does not apply to single-family housing.
Calendar and appeal process
The original stage plan envisioned starting the procedures in July 2023, resolving in March 2024, obtaining the license in July 2024, and finishing the works in July 2025, with the first occupancy license in September 2025. The agreement now published ends the administrative route, therefore, a contentious-administrative appeal may be filed against it before the Contentious-Administrative Chamber of the High Court of Justice of the Community of Madrid within two months from the day following publication, according to Article 46 of the Law Regulating Contentious-Administrative Jurisdiction. The text is signed in Leganés, on October 22, 2026, by the delegated councilor for Urban Development, Planning and Industry, Consumption and Sanitary Inspection, Francisco Javier Oporto Martín.
The approval closes a file opened more than three years ago and clears the way for building on two plots in the San Nicasio neighborhood that until now could not be developed under the current ordinance. For the neighbors, the publication opens a two-month window to challenge a plan that, according to the document itself, does not alter the roads or existing services but does alter the way of building within the block.
