The City Council of Las Palmas de Gran Canaria has appointed Araceli Hernández Martín as a confidential advisory member of the Technical Commission for the Assessment and Investigation of Workplace Harassment, Sexual Harassment, and Other Types of Discrimination (CTVAL), with Marina Más Clemente as the substitute. The appointment is formalized through the Resolution of the General Directorate of Human Resources number 2026-30284, of August 27, published in the Official Gazette of the Province of Las Palmas number 110, of September 14, 2026 (reference 1797629, page 16061).

The measure implements the Protocol for Action in Situations of Harassment in the Work Environment of the City Council of Las Palmas de Gran Canaria, approved by the Occupational Health and Safety Committee on April 15, 2026, certified on May 4, and definitively approved by the Resolution of the General Directorate of Human Resources number 2026-26936, of July 30, published in BOP number 93, of August 5, 2026. The CTVAL itself was established by Resolution number 2026-29841, of August 25.

Specialized reinforcement against sexual harassment

The protocol provides that when a complaint refers to possible situations of sexual harassment, harassment based on sex, sexual identity or orientation, gender expression, or sexual characteristics, the CTVAL shall incorporate an additional member: a confidential advisory member with specific training in the matter.

The appointed person will intervene in these cases with full respect for the principles of confidentiality, impartiality, diligence, and protection of the individuals involved. Their action will be advisory, preventive, and supportive, and will be subject to the functions, guarantees, and obligations of Section III of the protocol.

When the initial assessment report finds no motivation related to sex, sexual identity or orientation, gender expression, or sexual characteristics, the procedure will continue to be processed by the CTVAL without the participation of the confidential advisor.

A broad regulatory framework

The resolution is supported by a broad legal body that includes ILO Convention 190 on violence and harassment (2019), Organic Law 3/2007 for the effective equality of women and men, Organic Law 10/2022 for the comprehensive guarantee of sexual freedom, and Law 4/2023 for the real and effective equality of trans people and the guarantee of LGBTI rights.

The framework is completed by the Workers’ Statute, the Basic Statute of Public Employees, Law 31/1995 on the Prevention of Occupational Risks, Law 2/1987 of the Canarian Public Service, and Law 7/1985 Regulating the Bases of the Local Regime.

Composition and functions

The appointment is part of the update promoted during 2025 by the General Directorate of Human Resources, which replaces the protocols approved by the resolutions of the Director General of Public Administration number 46186/2020 and number 46187/2020, dated December 22, 2020.

  • Titular confidential advisory member: Araceli Hernández Martín.
  • Substitute confidential advisory member: Marina Más Clemente.
  • Resolving body: General Directorate of Human Resources, led by María Teresa Rodríguez Sánchez.
  • Intervention: Technical General Secretariat of the City Government Board, headed by the chief official Domingo Arias Rodríguez.

The resolution, which exhausts administrative remedies, may be appealed for reversal within one month or through a contentious-administrative appeal within two months for civil service personnel, and through a claim before the social jurisdiction for contractual personnel.

The designation of the confidential advisory member consolidates the new municipal protocol as a key tool for the protection of workers of the City Council of Las Palmas de Gran Canaria against workplace and sexual harassment, providing the CTVAL with a specialized profile that guarantees an initial expert and confidential assessment of the most sensitive complaints.
