Lalín denounces the labor personnel agreement and opens a new negotiation
Por FactBox Admin

The Lalín City Council has formally denounced the Collective Agreement of the labor personnel in the service of the corporation in order to open a new negotiation period. The Xunta de Galicia ordered the deposit, registration, and publication of this denunciation in the Official Gazette of the Province of Pontevedra (BOPPO) no. 211, of Monday, November 2, 2026, by means of a resolution from the Territorial Department of Pontevedra of the Ministry of Employment, Trade and Emigration (official reference 2026076069). The request for registration and deposit was entered into the aforementioned department on September 25, 2026.
The resolution is framed within article 8.3 of Royal Decree 713/2010, of May 28, on the registration and deposit of agreements, collective labor agreements, and equality plans, which obliges the labor authority to order the registration, deposit, and publication in the corresponding official gazette of the agreements reached within the scope of its competence. The royal decree itself collects in its article 2.2 the obligation to register the denunciations provided for in article 86 of the Workers’ Statute.
The competence of the body is resolved, according to the published text, by the provisions of Decree 49/2024, of April 22, which fixes the organic structure of the ministries of the Xunta (DOG no. 81, of April 24, 2024), and in Decree 147/2024, of May 20, which establishes the organic structure of the Ministry of Employment, Trade and Emigration (DOG no. 101, of May 27, 2024).
The current agreement and its annual extension
The text that is now being denounced was signed on June 20, 2024, and registered in the Territorial Department on July 11 of the same year. The identifiers appearing in the communication sent by the labor authority are as follows:
- Management file: 1247/2022.
- REDCOM file: 36/13/0174/2024.
- Agreement Code: 36105482012024.
- Signature date: June 20, 2024.
- Registration date: July 11, 2024.
Article 5 of the agreement, dedicated to the temporal scope, validity, and denunciation, established a validity until December 31, 2024, understood to be extended annually in the absence of a denunciation by any of the parties. This same precept imposes the obligation to communicate the denunciation three months in advance of the end of the validity or any extension, and requires the constitution of the Negotiation Table within a maximum period of one month.
Supervening regulations requiring the text to be revised
The Council’s agreement justifies the denunciation based on the entry into force of basic state and regional regulations of an imperative and supervening nature that would leave multiple clauses of the agreement obsolete or in conflict with the higher-ranking norm. The resolution expressly cites:
- The RDL 5/2023, modifying leaves for care and reconciliation.
- The Royal Decree 1060/2022, regarding the electronic justification of temporary disability.
- The LO 10/2022 and Law 11/2007 regarding vicarious and gender-based violence.
With that argument, the Department of Internal Regime agreed to exercise the right of termination (denuncia) provided for in article 5 of the agreement itself to avoid the application of clauses that could be null and void and to draft an updated text that legally shields the municipal action. The termination was agreed upon by the City Council, and its communication to the legal representation of the civil service staff is dated September 17, 2026.
Staff representation, deposit, and appeal
The municipal agreement orders that the termination be brought to the attention of the legal representation of the labor staff —Works Council, staff delegates, and union sections— urging them to constitute the negotiating table within a maximum period of one month. The formal communication was addressed to the Vigo Territorial Department (REDCOM) of the Ministry of Employment, Trade, and Emigration, and is signed by the Councilor for Internal Regime, Paz Pérez Asorey.
In the operative part, the labor authority orders the deposit and registration in the Registry of agreements, collective labor agreements, and equality plans of the Autonomous Community of Galicia, as well as publication in the BOPPO. The resolution does not end the administrative route: an appeal (recurso de alzada) may be filed against it before the General Secretariat of Employment and Labor Relations of the Ministry within one month from the day following notification, in accordance with Law 39/2015. The document incorporates the secure verification code 6JCM8LI6ZX2KPXTY.
The termination formally opens a new stage in the labor relations of the Lalín City Council and affects the entirety of its labor workforce, which will see the current regulatory framework replaced by a text adapted to current legality. The one-month deadline to constitute the negotiating table makes autumn a decisive period for union representation and for the municipal government, which must agree on updated working conditions before the annual extension expires.
