La Roca del Vallès investigates the ownership of a plot of land in Can Colet

La Roca del Vallès investiga la propietat d'un terreny a Can Colet

The City Council of La Roca del Vallès has opened an ex officio investigation file to determine the ownership of a set of plots of land located on Puiggraciós Street, in the Can Colet sector, included within the scope of the urgent protection project against floods of the Torrent del Calderó. This is established by Mayoral Resolution no. 2220/2026, signed by Mayor Marta Pujol i Armengol on October 22, 2026, and published in the Official Gazette of the Province of Barcelona (BOPB) on October 29, 2026, with reference CVE 202610157953 and municipal file 247010W.

The file arises from the advancement of another procedure. Mayoral Resolution no. 2132, of October 13, 2026, initially approved, on an urgent basis, the executive project for protection measures against floods of the Torrent del Calderó, a process that was submitted for public information for fifteen business days via an edict published in the BOPB on October 15, 2026 (CVE 202610153529).

The initiation is based on Law 7/1985, of April 2, regulating the bases of the local regime; Royal Decree 1372/1986, of June 13, which approves the Regulation of assets of local entities; Law 33/2003, of November 3, on the heritage of public administrations, and Royal Decree 1373/2009, of August 28, which approves its general regulation. The mayor’s office acts in the exercise of the powers of article 21 of the LRBRL.

A technical report without accredited ownership

The trigger is a report from the municipal architect issued on October 20, 2026, which notes the existence of a set of plots of land “for which there is no reliable evidence of ownership.” The report points to indications of municipal ownership: the lands would be part of a road network ceded “since time immemorial” to the City Council, according to the inventory of municipal assets, which lists the roads of La Roca Centre and Can Colet in file RC-1/V1.

The document warns, however, of two doubts. On one hand, the layout of the road network in the sector, executed according to the Can Colet urbanization project definitively approved by the City Council Plenary on June 16, 1994, “does not exactly match” the forecasts of the PGOU —map RC-1, general and organic structure of the territory— such that the inclusion of these lands in the road system is doubtful, especially because, due to their current physical reality, they are not intended for public use as a road. On the other hand, there are doubts as to whether the lands may be considered public hydraulic domain. The Municipal Secretariat issued a complementary report on October 21, 2026.

The lands under investigation

The resolution specifies the scope of the investigation on the lands located between the boundary of the cadastral plots identified in the project documentation and the boundary of Puiggraciós Street:

  • Cadastral reference 08180A027000650000TW
  • Cadastral reference 08180A027000660000TA
  • Cadastral reference 08180A028000140000TG

The affected area is the one highlighted in orange in the image accompanying the resolution, and the project documentation can be consulted via the link published in the bulletin.

Fifteen days of exhibition and one month for allegations

The resolution orders the publication of the agreement in the BOPB and on the notice board of the La Roca del Vallès City Council for fifteen days. Once this period has elapsed, and for one month, any interested person may submit allegations and provide public judicial, notarial, or administrative documentation, as well as request recognition and an expert opinion and propose the declaration of witnesses.

The resolution is also notified to the Catalan Water Agency, as a known and identifiable interested party, and it will be reported to the Plenary in the next session it holds. Access to the file can be requested electronically via the municipal Electronic Office or in person at the offices on Catalunya Street, 18-24, in La Roca del Vallès.

The decision directly affects the owners of the adjacent estates and the residents of the Can Colet neighborhood, who will see how the protection against the floods of the Torrent del Calderó now depends on previously resolving who is the owner of certain lands that the City Council considers its own but cannot documentally prove.
