Por FactBox Admin

The Comú de la Massana has provisionally approved the second revision of the Parish Planning and Urbanism Plan (POUP), according to the Decree of 10-23-2026 published in BOPA no. 122, dated October 28, 2026, in section 09 (Comú de la Massana / POUP). The agreement, adopted by the Comú Council in the session of October 23, 2026, forwards the complete file to the Government of Andorra to obtain its prior approval. The same decree entails the suspension of building and subdivision licenses in the sectors affected by the new planning.
From the public information process to provisional approval
The project was submitted for public information by agreement of the Comú Council on June 29, 2026, made public by the Decree of June 29, 2026 in BOPA no. 73, dated June 30, 2026. The period ended on September 22, 2026, with a total of 106 allegations submitted.
The Comú has analyzed the allegations and incorporated the modifications it deemed appropriate into the Plan’s documentation. The decree expressly states that these modifications are not substantial in nature with respect to the plan that was submitted for public information.
The provisionally approved technical and regulatory documentation incorporates the amendments derived from the resolution of the allegations and the corresponding technical corrections. It can be consulted at the link https://www.lamassana.ad/portal-poup.
Submission to the Government and legal effects
Article 2 of the decree orders the submission of the file to the Government of Andorra for prior approval, in accordance with articles 98, 99, and 104 of the General Law of Land Use and Urbanism (LGOTU), of December 29, 2000. Once prior approval, whether express or tacit, is obtained, the Comú will proceed to the final approval and the corresponding publication in the BOPA, according to article 100 of the LGOTU.
Article 4 establishes that the decree takes effect from its publication, but that the second revision will only acquire regulatory efficacy upon the publication of the final approval. The applicable regulation also includes the Urban Planning Regulations of October 3, 2012, especially article 54, and articles 11, 89, 91, 92, 93, 95 to 100, 103, and 104 of the LGOTU.
The current POUP is that of the first revision, definitively approved on March 2, 2016, and published in BOPA no. 15, dated March 9, 2016, along with its subsequent modifications.
Suspension of licenses in sectors with changes
Article 3 of the decree applies article 91 of the LGOTU: provisional approval entails, by itself and necessarily, the suspension of the granting of:
- Subdivision licenses.
- New urbanization licenses.
- Building licenses for new construction.
- Consolidation licenses for existing works.
The suspension affects all sectors in which the new planning entails any modification of the previous urban regime and remains subject to the time limits of article 92 of the LGOTU.
Other urban planning decisions from the same plenary session
The session of October 23, 2026, also resolved other parish planning files published in the same BOPA no. 122:
- Final approval of the specific modification of the POUP regarding the change of classification of action unit E-124, from Residential Zone (ZR) to Service Zone (ZS1), and the adjustment of the boundary with unit E-125, with the lifting of the suspension of licenses in the affected area.
- Final approval of the Partial Development Plan for the developable land action unit E-126, at carretera de la Gonarda, numbers 31-37, in the district of Aldosa, promoted by all owners; the affected parties made public are Casa Tadora, SL and Joan Gabriel Estany.
- Final approval of the correction of the buildability figures for lobes 3, 6A, 6B, 6C, and 7 of action unit N-012, returning them to those of the first revision of the POUP from 2016.
All agreements bear the signature of Eva Sansa Jordan, mayor of La Massana, and are published for general knowledge.
