The Provincial Council exhibits the provincial electric charging service for thirty days
Por FactBox Admin

The Diputació de Lleida has opened for public consultation, for thirty business days, the project for the establishment of the “Provincial electric vehicle charging service,” agreed upon by the corporation’s Plenary in the ordinary session of October 15, 2026. The agreement is published in the Official Gazette of the Province of Lleida (BOP) no. 205, of October 27, 2026 (CVE BOP-2026_0_205_8903, edict 8903, pp. 1-15) and is accompanied by the prior public consultation, the text of the service regulations, and the ordinance regulating public prices.
Plenary no. 09/2026 approved the initiation of the procedure for the implementation of the public service and the provincial economic initiative, and agreed to submit it to public information and grant a hearing to interested parties during the same period, in accordance with article 160.1 of the Regulations on works, activities, and services of local entities (ROAS). Allegations may be submitted through any of the means permitted by Law 39/2015, of October 1, on the common administrative procedure.
The framework of the initiative is the provincial policy for sustainable mobility and energy transition. The initial infrastructure is linked to the Tourism Sustainability Plan for the Destination “Naturalmente Lleida” and to investments funded by Next Generation EU funds, and the provision is subject to Regulation (EU) 2023/1804 on alternative fuels infrastructure. As a precedent, the bulletin includes the supply contract for 75 charging points awarded to AXAL Power B.V. within the framework of that plan, with a certification on account of 906,265.80 euros (BOP no. 201, of October 21, 2026).
Initial scope of two points at La Caparrella
The regulation establishes that the service will start with the two charging points at the La Caparrella Complex, which is provincially owned, already installed and legalized. The rest of the network will be built through the voluntary adhesion of other local entities, without the need to modify the regulation.
- The incorporation of municipal points will be formalized through an agreement or equivalent legal instrument.
- It will not be necessary to transfer ownership of the equipment, but the management and exploitation rights must be attributed to the Diputació to act as the charge point operator (CPO).
- It must be proven that the point is ready, legalized, and safe, with a favorable technical report on platform compatibility, communications, billing, and monitoring.
- The service is provided under direct management, with the possibility of contracting auxiliary or technological services (platform, telecommunications, payment gateway, maintenance, or EMSP services).
Rate of 0.35 euros per kilowatt hour and access without registration
The use of the service is subject to a fee and is governed by the public price ordinance, which the regulation neither fixes nor modifies. The public consultation, however, specifies a reference rate of €0.35/kWh for fast charging points and provides for the evaluation of a specific rate for points with a nominal power equal to or less than 7.5 kW.
- Occasional charging without prior registration must be permitted when sector regulations require it and technical specifications allow it.
- Access via mobile application, web portal, RFID card, QR code, or any interoperable EMSP is also provided for.
- Before starting the session, the user must know the identification of the point, the power, the applicable price, and the payment methods.
- As a general rule, access cannot be conditioned on residency in a municipality or for a tourist purpose.
- Billing must be linked to the energy actually supplied.
The approved text consists of 33 articles distributed across a preliminary title and five further titles, in addition to two additional provisions, one transitional provision, and one final provision.
Fines of up to 3,000 euros for tampering or fraud
Title V establishes the sanctioning regime for conduct contrary to the regulations regarding the use of the service and the facilities, without prejudice to traffic, parking, or consumer regulations.
- Minor infractions: warning or a fine from 100 to 750 euros.
- Serious infractions: fine from 751 to 1,500 euros.
- Very serious infractions: fine from 1,501 to 3,000 euros.
- Statute of limitations for infractions: six months for minor, two years for serious, and three years for very serious.
Very serious conduct includes deliberately tampering with the station’s hardware or software, acts of sabotage, and falsifying identification or payment data to evade payment.
The document is signed by the president of the Diputació de Lleida, Joan Talarn Gilabert, dated October 22, 2026. If no claims are presented during the public exhibition, the establishment of the service will be definitively approved without the need for a new plenary agreement, via a resolution from the presidency that will be published in the bulletin and on the electronic office.
The impact of the measure is territorial: the provincial model allows smaller town councils, without their own technical capacity, to integrate their points into a common management, maintenance, and support platform, and provides effective utility to a public infrastructure already installed that until now had no legal or economic operational framework.
