The Ministry executes the ruling confirming the consumer sanction against Endesa Energía
Por FactBox Admin

The Principality of Asturias has ordered the execution on its own terms of the judgment that closes the judicial dispute with Endesa Energía regarding a consumer affairs sanction. The Regional Ministry of Territorial Planning, Urbanism, Housing, and Citizen Rights mandates the fulfillment of the ruling through a resolution signed on October 15, 2026, and published in the Official Gazette of the Principality of Asturias (BOPA) no. 213, dated November 4, 2026, in section I. Principality of Asturias, under official reference 2026-08768.
The resolution declares as final judgment number 106, of September 4, issued by the Court of First Instance of Oviedo, Contentious-Administrative section, court no. 5, which resolved the summary proceeding 15/2026. The court fully dismissed the electric company’s challenge, meaning the sanction imposed by the regional Administration remains intact in all its terms.
Chronology of file SANC/2025/3759
The origin of the case is the sanctioning resolution issued on October 9, 2025, by the head of the Ministry, within the consumer affairs sanctioning procedure number SANC/2025/3759. Against it, Endesa Energía filed an appeal for reversal, which was rejected, thereby opening the judicial route before the Court of First Instance of Oviedo.
The administrative file therefore accumulates three linked acts:
- Sanctioning resolution of October 9, 2025, from the regional minister of the department.
- Resolution dismissing the appeal for reversal, dated November 19, 2025, according to the text of the judicial ruling.
- Judgment number 106, of September 4, of summary proceeding 15/2026, dismissing the contentious-administrative appeal.
The published text includes a discrepancy in dates that is worth noting: in the first paragraph of the resolution, both administrative acts are dated October 9, 2025, while the operative part of the transcribed judgment places the resolution dismissing the reversal on November 19, 2025.
The ruling: full dismissal and no costs
The operative part of judgment number 106 is explicit: “I must dismiss and do dismiss the contentious-administrative appeal” filed by Endesa Energía, S. A. U. against the Ministry’s resolution of November 19, 2025, thus confirming the sanctioning resolution of October 9, 2025, in file SANC/2025/3759. The ruling adds that no “special pronouncement is made regarding costs,” meaning each party bears its own.
The regional resolution also notes that the company appeared represented by its legal counsel and that the procedure was processed via the summary route, which is provided for disputes of lower complexity before the contentious-administrative jurisdiction.
Execution and legal framework
The Department bases the execution on Article 26 of Decree 20/97, of March 20, which regulates the organization and operation of the Legal Service of the Principality of Asturias, and on Articles 103 et seq. of Law 29/1998, of July 13, regulating Contentious-Administrative Jurisdiction. The agreement is structured into two points: to execute the ruling in its own terms and to order its publication in the BOPA.
The document is signed in Oviedo, on October 15, 2026, by the Councilor for Territorial Planning, Urbanism, Housing, and Citizen Rights, Ovidio Zapico González. The resolution does not detail in its text the amount of the fine nor the specific sanctioning provision applied, details which appear in the administrative file from which it originates.
Impact for consumers
The case confirms that regional consumer sanctions against large electricity marketers withstand judicial review when the processing is correct. The result reinforces the position of the Department and the consumer services against the appeals of electricity companies, and establishes a useful criterion: the finality of the judgment mandates the execution of the administrative act without room for reinterpretations.
