Housing approves the 2026/2027 Inspection Plan for all the Islands

The Minister of Housing, Territory and Mobility, José Luis Mateo Hernández, has approved the Housing Inspection Plan 2026/2027, as proposed by the Director General of Housing and Architecture, José Francisco Reynés Sancho. The resolution, numbered 9502, is published in the Official Gazette of the Balearic Islands (BOIB no. 120, of September 24, 2026, Sec. III, p. 51674) and orders inspections for the last quarter of 2026 and for the entire year of 2027 across the Balearic Islands.

The text is based on a proposal formulated on September 16, 2026, and electronically signed on September 17, and is grounded in Law 5/2018, of June 19, on housing in the Balearic Islands, which grants the Autonomous Community the power of inspection and sanction in housing matters and provides for a body of inspectors attached to the competent ministry. The resolution also invokes Decree 1/2024, of January 5, on sanctioning procedures; Law 3/2024, of May 3, on urgent housing measures; Law 4/2026, of June 11, on urgent measures to accelerate strategic projects; and laws 39/2015 and 40/2015, on common administrative procedure and the legal regime of the public sector.

Objectives: HPO, HPL, deposits and large holders

The general objective is to ensure compliance with housing regulations, especially the legal regime of official protection housing (HPO) and limited price housing (HPL), and to promote a socially appropriate use of the residential stock. The specific objectives are:

  • Control of the legality of HPO and HPL: beneficiary requirements, transfer, effective use, and maximum prices.
  • Control of compliance with the regulations regarding the deposit of rental bonds.
  • Location and verification of substandard housing and overcrowding, especially in areas of higher social risk.
  • Control of infractions by large holders: right of first refusal and withdrawal, communication of vacant housing, and non-payment of community expenses.

The prioritization criteria are the severity and social impact of the possible infraction, the effect on people in situations of vulnerability, and the improper use of protected housing. The territorial scope covers all the Islands, with continuous actions in Mallorca and Ibiza and periodic actions in Menorca and Formentera, subject to the availability of sufficient personnel.

Programming: 74 HPO developments and ten HPL

Provided that sufficient personnel are available, the plan provides for:

  • Inspect sixty HPO developments in Mallorca, prioritizing those that have never been visited and, if possible, in tourist municipalities during the season.
  • Inspect four HPO developments in Menorca.
  • Inspect ten HPO developments in Ibiza and Formentera.
  • Inspect ten HPLs already registered in the Registry.
  • Verify the deposit of rental guarantees at the IBAVI for sixty properties dedicated to housing and sixty for other uses.
  • Check for possible infractions by large holders, including the non-payment of community expenses in 25 properties.
  • Verify compliance with the regulations governing real estate agents (Laws 5/2018 and 3/2024).
  • Act ex officio or based on complaints from individuals and administrations, especially regarding substandard housing.

These actions are accompanied by advertising campaigns regarding the endorsement of rental, sale, and transfer of use contracts, maximum prices, beneficiary requirements, and the duty to cooperate with inspection personnel. The programming is provisional and may be adapted during the term of the plan according to available resources and the volume of complaints.

Means, methodology and monitoring

The Housing Inspection Service has four inspectors in Mallorca, one inspector in Ibiza, one head of service, one head of section, four instructors for sanctioning proceedings, and three administrative assistants, in addition to one inspection vehicle. It also has access to municipal registers, the HPO and IBAVI databases, tax information of beneficiaries, the Virtual Office of the Cadastre and the Property Registry, and can request information from owners, tenants, real estate agents, homeowners’ associations, and utility companies.

Actions are carried out through annual planning, on-site inspections, requests for documentation, cross-referencing data between registries, inspection reports and, if applicable, the initiation of sanctioning proceedings. Monitoring will be conducted using indicators such as the number of inspections per island and type of infraction, the percentage of actions with detected incidents, the proceedings initiated, the average processing time, and the degree of execution of the plan; the General Directorate of Housing and Architecture must prepare a monitoring report at the end of the 2027 financial year.

The plan directly affects developers, owners, and tenants across all the Islands, and reinforces control over the use of protected housing and the rental market in a context of residential pressure. Its effective application will, however, depend on available staff, as the text itself conditions the actions in Menorca, Formentera, and the remaining lines of work to the availability of personnel and material resources.
