The Department of Housing and Urban Agenda of the Basque Government and the College of Notaries of the Basque Country have signed a cooperation agreement for the processing of real estate data. The agreement was signed on September 28 via electronic headquarters and was published on October 16 in issue number 198 of the Official Gazette of the Basque Country, under reference 2026/4331. The publication was carried out through Resolution 94/2026, signed on September 30 by Jon Iñaki Urbina García de Vicuña, Director of the Government Secretariat and Parliamentary Relations.
The agreement has two signatories: on one hand, the General Administration of the Basque Autonomous Community, represented by Denis Itxaso González, Commissioner of Housing and Urban Agenda; and on the other, the Honorable College of Notaries of the Basque Country, represented by Dean Angel Félix Nanclares Valle, under the support of the agreement of its Governing Board dated March 25, 2025. The legal basis is Article 10.31 of the Statute of Autonomy of the Basque Country, which establishes that housing and territorial planning are the exclusive competence of the community, together with Article 10 of Law 3/2015 (Housing Law) and the support of Law 10/2023 (Basque Statistical Plan 2023-2026). The signatories have complied with Article 49 of Law 40/2015, which regulates the minimum content of agreements.
What the agreement includes
The purpose of the agreement is to establish cooperation mechanisms between the General Administration and the College of Notaries to produce statistics and better understand the real estate situation in the Basque Country. The cooperation is implemented by providing access to the Notariat’s statistical platform, allowing the Department of Housing and Urban Agenda to process statistical data regarding real estate transactions registered in the Basque Autonomous Community. The data are anonymized.
The indices compiled by notaries are collected according to Article 17 of the Notary Law and Article 286 of the Notarial Regulations, from which the Computerized Single Index is derived. Article 314 of said regulations establishes that notary colleges are public law corporations and that the dean holds the representation.
Data and their technical details
The annex of the agreement specifies what information the platform will provide:
- Geographic areas: Basque Country, Araba, Bizkaia, and Gipuzkoa; Bilbao, Donostia, and Vitoria-Gasteiz; all municipalities in the community, municipal districts, census sections, and any other provided geographic division.
- Types of assets: housing, garages, storage rooms, commercial premises, and industrial warehouses.
- Variables: sale price, price per square meter, and number of sales.
- Time period: number of sales from 2024 onwards; price per square meter and sale price from the fourth quarter of 2024 onwards; municipal-level breakdowns from the first quarter of 2024 onwards.
- Updates: monthly, and a report every three months, translated into Basque.
Data Protection and Confidentiality
The processing of personal data is regulated according to Regulation (EU) 2016/679 and Organic Law 3/2018. It is established that both parties are responsible for the processing of data within the scope of their competencies, and no one is considered the sole controller of the processing. Furthermore, the data are under the protection of statistical confidentiality, according to Law 12/1989 and Law 4/1986, and are included in the processing activity named “Statistical research and surveys,” with ID number 385.
Budget and Duration
The agreement includes a financial commitment on behalf of the Department of Housing and Urban Agenda:
- Amount: 65,000 euros plus VAT, totaling 78,650 euros (including 21% VAT).
- Per quarter: 19,662.50 euros (including VAT).
- Year 2026: one quarter, 19,662.50 euros.
- Year 2027: three quarters, 58,987.50 euros.
Payment will be made quarterly, following the delivery of the results updates and reports specified in the annexes. The duration of the agreement is one year, starting from the date of the last signature, and may be extended annually, provided that appropriate credit is available and the statistical operations continue to be part of the Basque Statistical Plans; extensions will update the amount according to the general VAT index.
Monitoring
A Monitoring Committee will be formed, chaired by the head of the Directorate of Housing Planning and Enabling Processes. The committee will consist of two people as representatives of the College of Notaries and two other technical profiles on behalf of the Directorate of Housing and the Department’s Specific Statistical Body. The committee will meet once a year to analyze the fulfillment, interpretation, and future changes of the agreement.
The agreement has a direct impact on housing policy planning: the Government will have aggregated data from notary registries at the municipal and census section level, which will allow for a more precise measurement of the evolution of the housing and rental market. These data will not be used for the identification of individuals, but rather for statistics, ensuring the protection of privacy in exchange for improving public information.
