The Parliament is processing the law that will limit the entry of vehicles to Mallorca

The Parliament of the Balearic Islands has published in the Official Gazette of the Balearic Islands the Bill for the regulation of vehicle influx to the island of Mallorca (RGE no. 9481/26), the text that empowers the Insular Council of Mallorca to set an annual ceiling on vehicles and charge an entry fee. The initiative is processed under number 9414 and appears in BOIB no. 118, dated September 22, 2026, after the Plenary of the chamber took it into consideration on September 9 and the Board agreed to continue its processing on September 16.

The text is published to give effect to article 139.6 of the Parliament Regulations and is signed by the president of the chamber, Gabriel Le Senne Presedo, dated September 17, 2026. The proposal is structured into 6 titles, 5 additional provisions, 3 transitional provisions, 1 repealing provision, and 4 final provisions, and is framed within the precedents of Law 7/2019 of Formentera, Law 5/2024 of Ibiza, and Law 3/2023 of Menorca.

The explanatory memorandum justifies the regulation with data from IBESTAT: Mallorca received 13,389,923 tourists in 2024, 912,426 more than in 2023, and has 989,047 inhabitants and 3,650 km². The Council’s road network totals 1,793 kilometers, of which 1,502 are conventional roads, and 71% of the vehicles accumulated on the island since 2020 have not been incorporated into the vehicle fleet, meaning they belong to external fleets or non-residents.

An annual vehicle ceiling and an entry fee

The Insular Council of Mallorca assumes the competence to regulate the influx and the maximum capacity of vehicles, and its Plenary must establish, on an annual or biennial basis, the maximum ceiling of vehicles with authorization for entry and stay. The agreement requires a prior hearing with the island’s city councils for ten business days and must be published in the BOIB at least three months before the regulation comes into force.

The obtaining of accreditation and the collection of the fee will be done electronically, and automatic license plate reading systems may be installed. The Mobility Policy Coordination Commission of Mallorca is also created, composed of the Council, the Government of the Balearic Islands, the city councils, and the General State Administration, as well as a sustainability fund funded by the fee and sanctions.

Exceptions for residents, renters, and public services

The following are exempt from the prohibition regime:

• Vehicles owned by residents of Mallorca with a tax domicile on the island, except those intended for rental.
• One vehicle per property for non-residents who own a home in Mallorca.
• Leasing or renting vehicles owned by residents.
• Travel for medical reasons from Formentera, Menorca, or Ibiza, and temporary travel for work reasons.
• Vehicles serving people with reduced mobility.
• Official and public service vehicles: security forces and bodies, firefighting, ambulances, hearses, civil protection, public and school transport, taxis, and waste collection.
• Authorized rental vehicles tax-domiciled in Mallorca, goods transport, tractors, and excavators.

The Plenary may set the maximum number of rental vehicles that enter the island annually and those that circulate during control periods, reserving a percentage for electric or non-polluting vehicles.

Fines from 300 to 30,000 euros and vehicle immobilization

The sanctioning regime provides for fines from 300 to 1,000 euros for minor infractions, from 1,001 to 10,000 euros for serious infractions, and from 10,001 to 30,000 euros for very serious infractions. Each vehicle constitutes an independent infraction.

For serious and very serious infractions, temporary immobilization of the vehicle between two and four months or the withdrawal of the authorization to circulate on the island may be imposed, with the impossibility of obtaining a new one for two years. The admission of responsibility and voluntary payment each reduce the sanction by 20%, and infractions expire after three, two, or one year depending on the severity.

Obligations for shipping companies and rental companies

Shipping companies operating lines to Mallorca and intermediaries or sellers of transport tickets must inform passengers of the restrictions, verify upon boarding that they have the accreditation, communicate in real time the license plates that disembark and embark, and collect the fee along with the ticket.

Driverless rental companies must daily communicate the license plates of the vehicles entering and leaving the island. The Council must approve an implementation regulation within 24 months and initiate the processing of the tax ordinance for the fee within three months.

If Parliament approves the text, the regulation will enter into force the day after its publication in the BOIB and will require residents, second-home owners, rental companies, and the overall tourism sector of Mallorca to adapt to a restriction calendar set by the Island Council.
