The Government deploys Law 5/2025 on industrial promotion areas
Por FactBox Admin

The Governing Council has approved Decree 33/2026, of October 30, which provides the regulatory implementation of Law 5/2025, of July 18, on the management and modernization of industrial promotion areas in the Balearic Islands. The regulation is published in the Official Gazette of the Balearic Islands (BOIB) no. 139, of October 31, 2026, in Section I (provision 10987, page 59926), and enters into force the day after its publication. The text establishes the regime for the managing entities of the areas, creates a single autonomous registry, an information system, and a quality system, and regulates the declaration of Strategic Industrial Municipality.
The Decree is approved upon the proposal of the Minister of Enterprise, Freelancers, and Energy, Alejandro Sáenz de San Pedro García, and is signed by the President of the Balearic Islands, Margarita Prohens Rigo, with the prior report of the Consultative Council. The matter is the exclusive competence of the community according to article 30.34 of the Statute of Autonomy, and the impetus corresponds to the General Directorate of Industry and Industrial Estates, integrated into the Ministry of Enterprise, Freelancers, and Energy by means of Decree 10/2025, of July 14.
The text develops the tools already provided for in Law 5/2025 —industrial promotion areas, management and modernization entities (EGM), collaborative management entities (EGMC), the registry, the information system, and the declaration of Strategic Industrial Municipality— and maintains the sanctioning regime of title IV of Law 4/2017, of July 12, on industry. It consists of six chapters, 33 articles, one transitional provision, two additional provisions, two final provisions, and an annex.
Managing entities with positive silence in three months
EGMs are composed of the holders of real rights over properties located within the delimited area, who may be replaced by tenants or occupants if they formally communicate so. Their minimum functions include:
- Collaborating with the city council in conservation, maintenance, surveillance, cleaning, and basic services.
- Assuming the management of municipal services if agreed upon by the holders and assigned by the council.
- Promoting additional infrastructures and services, which must never substitute municipal ones.
- Representing common interests and conveying complaints to the city council.
- Collaborating in mobility plans and in the attraction of national or foreign investments.
The procedure begins with an exclusively electronic application through the Electronic Office, with a mandatory and non-binding municipal report within a period of one month and public information for one month. The maximum period for resolution is three months and, without notification, the application is understood to be granted by administrative silence; the certificate must be issued ex officio within fifteen days.
A single registry and control of modifications
The Regional Registry of Management Entities and Modernization of Industrial Promotion Areas is unique to the community, depends on the department competent in industry, and is assigned to the general directorate of the sector. Entities must communicate changes in name, address, geographical scope, sectoral scope, or governing positions within one month, and deregistrations require a reasoned resolution and a hearing process of no less than fifteen days. Access to information is provided via the web, and only basic data is public.
Strategic Industrial Municipality: taxation and deadlines halved
The declaration, granted by the counselor competent in industry matters, requires:
- That the city council plenary has approved the request, with a certificate from the secretariat.
- Having at least one industrial promotion area, or having one in process.
- Having current municipal tax benefits, such as rebates on the tax on constructions, installations, and works.
- That industrial and “servindustry” companies are prominent.
The effects are priority access to public funds and support programs, the non-competitive aid provided for in article 7.1.c of Legislative Decree 2/2005, and the resolution of municipal procedures in half of the legal timeframe. The designation can be revoked, with a minimum hearing of ten business days, and the resolution is published in the BOIB and on the cartographic viewer of the Cartographic and Geological Institute of the Balearic Islands.
Open industrial map and quality standard
The Integrated Information System of Industrial Promotion Areas (SIIAPI) will include a map of the areas, data from other public systems (urban, environmental, fiscal, energy, or employment), and indicator tables for quality, territorial sustainability, and economic impact, with free web access. Regarding the Quality System, it must cover at least the legal and urban requirements, basic infrastructure and services, organization and management, incident management, indicators and evaluation, value-added services for companies, and social responsibility with continuous improvement.
The transitional provision opens the door for associations, homeowners’ communities, and conservation entities that were already managing industrial areas before July 25, 2025, to acquire the status of EGM or EGMC, with georeferenced delimitation in the ETRS89/UTM zone 31N system.
The deployment provides legal certainty to installed companies and turns industrial areas into a competitive instrument for city councils wishing to attract investment, as it links municipal taxation, quality of services, and preferential access to public funds.
