Por FactBox Admin

The Government has authorized the free transfer of ownership of the property known as “La caseta de peó caminaire” (the road walker’s cottage), located on the Cadaqués road, km 4, in the municipality of Roses, in favor of the Roses City Council. The decision was adopted through Agreement GOV/266/2026, dated November 3, upon the proposal of the Minister of Economy and Finance, and is published in the Official Gazette of the Generalitat de Catalunya (DOGC) no. 9788, dated November 5, 2026. The official text appears under the reference CVE-DOGC-A-26307077-2026 and is signed by the Secretary of the Government, Javier Villamayor Caamaño.
The Generalitat de Catalunya owns the property by title of transfer from the Spanish State, according to Royal Decree 1943/1980, of July 31, regarding the transfer of the road service. It is a public domain property assigned to the Department of Territory, Housing and Ecological Transition, with real estate asset number 01379, and the operation is framed within Article 22 of the revised text of the Heritage Law of the Generalitat de Catalunya, approved by Legislative Decree 1/2002, of December 24.
A protected property next to Cap de Creus
The property is registered in the Property Registry of Roses number 1 under registration number 38563 and unique registration code 17019000443069. According to the description contained in the agreement, it is a plot of 353 square meters of land, with a built cottage of 208 square meters, currently decommissioned from the road service, in the area of La Torreta and with cadastral references 17161A001001770001ZK and 17161A001001770000BJ.
- Plot area: 353 m².
- Built area: 208 m².
- Plot 177 of polygon 1 of the Cadastre.
- Boundaries: to the north and east, the General Directorate of State Heritage; to the south, the road from Roses to Cadaqués (GI-614); to the west, the property of Ms. María Rosca Carbó.
The Special Plan of the catalog of heritage, buildings and assets of interest of the municipality of Roses grants the property a protection level C, and the building was declared a Cultural Asset of Local Interest (BCIL) in 2016.
Sixteen months of prior reports
The transfer comes after a long administrative itinerary, with favorable reports from all involved agencies:
- April 3, 2025: the Roses City Council requests the transfer from the Directorate General of Patrimony.
- June 27, 2025: the head of the Real Estate Asset Management Service of the Directorate General of Mobility Infrastructures issues a favorable report.
- October 23, 2025: the Technical Service of the Sub-directorate General of Movable and Immovable Patrimony values the property at 60,455.88 euros.
- February 26, 2026: the Property Registrar of Roses number 1 certifies the registration of the estate, effective from February 19, 2026.
- May 25, 2026: the Plenary of the Roses City Council accepts the conditions of the transfer.
- August 14, 2026: the Director General of Patrimony concludes that the property is not necessary for the purposes of the Generalitat.
- September 14, 2026: the Legal Advisory of the Department of Economy and Finance reports favorably.
- October 13, 2026: the General Comptroller issues a favorable audit.
Fifty years of sporting use and automatic reversion
The agreement obliges the council to designate the building for the creation of a support or reinforcement space for the sporting activities of local clubs. The Government justifies this purpose based on the fact that the location, within the Cap de Creus Natural Park and close to the center of Roses, can turn the property into a nerve center for entities that carry out most of their activities in the natural environment.
Furthermore, the City Council must maintain this purpose for the following 50 years and execute the adaptation works within a period of 5 years from the signing of the administrative transfer document. Non-compliance entails the automatic and legal reversion of the asset to the patrimony of the Generalitat, without right to compensation for the transferee entity and with the obligation to also answer for damages and detriment caused. The agreement empowers the Director General of Patrimony to sign the transfer document and provides for its notification to the Roses City Council.
The news is relevant because it resolves a municipal request initiated more than a year and a half ago and adds value to a protected building that until now was decommissioned: Roses gains a facility for the local sporting fabric and the Generalitat disposes of a property it does not consider necessary, with guarantees of reversion if the agreed purpose is not fulfilled.
