Chandrexa de Queixa approves the regulation for two days of remote work per week
Por FactBox Admin

The City Council of Chandrexa de Queixa has definitively approved the Regulation on the provision of services in the teleworking modality, which allows municipal staff to work remotely up to two days per week. The initial plenary agreement, adopted in the session of July 29, 2026, was definitively adopted as no claims were presented during the public exhibition period. The text is published in the Official Gazette of the Province of Ourense on October 7, 2026, in section IV. Local Entities (edict no. 352678).
The definitive approval occurs in accordance with article 49 of Law 7/1985, of April 2, regulating the bases of the local regime. The regulation aims to regulate the conditions and the procedure for authorizing teleworking for all personnel providing services in the council, and will be compatible with any current working day modality or type of schedule. The regulation will enter into force on the day following its publication in the provincial gazette.
An administrative-law appeal may be filed against the agreement before the Administrative Chamber of the High Court of Justice of Galicia within two months from the day following publication, according to article 46 of Law 29/1998, of July 13, of the administrative-law jurisdiction.
Two days weekly and annual authorization
In the ordinary modality, the worker chooses the preference of days in their application and may telework a maximum of two days per week, an amount that may be reduced with justification according to the needs of the position. The rules are flexible in cases of force majeure, such as mobility restrictions, blackouts, climate emergencies, adverse weather conditions, or pandemics.
The authorization has a duration of one year, with a minimum period of four months, and is automatically extended as long as the circumstances that motivated it persist and neither party exercises the right to revert the modality. Exceptionally and for justified reasons, it may be granted for a period shorter than one year. The modality is voluntary and reversible for both the applicant and the Administration, and the daily working day cannot be split between in-person and non-in-person.
Requirements, procedure and deadlines
To obtain the authorization, one must be in active service in a position susceptible to teleworking, have sufficient computer and data protection knowledge, have a workspace compliant with occupational risk prevention regulations, and have a stable Internet connection.
The procedure is initiated by a request from the interested person addressed to the Mayor’s Office, submitted electronically or physically at the General Registry. If the request is incomplete, there are 10 business days to remedy the deficiencies. The Secretariat issues a report within 10 days, and the report on technological availability is resolved within 15 days. The resolution must be notified within a maximum period of one month; the absence of an express pronouncement is understood as dismissed by administrative silence.
Excluded positions and special regime
Positions in registry offices, citizen service and information, driving personnel, tractor drivers and laborers, those who carry out their workday permanently outside administrative premises, and those whose functions necessarily require physical presence cannot be performed under a teleworking regime.
The regulation provides for a special regime, authorized by the Mayor’s Office, for extraordinary cases: gender violence, vulnerability of the employee, health or climate emergencies, construction works and other circumstances of force majeure, and occupational risk prevention needs. In this modality, teleworking may be extended to all weekly and monthly working days, and it is reviewed every semester.
Suspension, extinction and transition
The authorization may be suspended ex officio due to service needs or lack of means, or at the request of the interested party. Suspension implies a return to the in-person modality within a maximum period of two business days, and the restart also occurs within two business days once the cause has disappeared. The Administration may require presence at the center with a minimum notice of 36 hours for justified urgent needs.
The authorization ceases to be effective, among other causes, due to the expiration of the term, change of job position, repeated failure to meet objectives or technical conditions, or a request from the teleworker submitted 10 business days in advance. The transitional provision requires all pre-existing teleworking grants to submit a new application within a maximum period of one month from the date of entry into force.
The regulation guarantees compatibility with the right to digital disconnection provided for in Article 88 of Organic Law 3/2018, of December 5, and includes an annex with a self-assessment questionnaire on occupational risk prevention. The regulation thus establishes, for the first time in a regulated manner, the working conditions of the council’s public employees who choose to work remotely.
