Por FactBox Admin

The City Council of Cabana de Bergantiños hereby opens for public inspection, for fifteen business days, the expropriation of the assets and rights necessary to execute the environmental improvement and enhancement of the Monte San Sebastián-Malecón coastal edge. The agreement for the declaration of public utility and necessity of occupation was adopted by the Plenary of the Municipal Corporation in the session of September 24, 2026, and is published in the Official Gazette of the Province of A Coruña number 199, dated October 19, 2026, under announcement number 2026/6617. This same publication serves as notification to unknown interested parties, those whose place of notification is unknown, or those to whom notification could not be delivered.
The file, registered under number 2026/U040/000001, is processed in accordance with the Law of December 16, 1954, on compulsory expropriation and the Regulation approved by the Decree of April 26, 1957, which grants the corporate Plenary the competence to adopt this agreement. The municipal intervention has issued a certificate of the existence of appropriate and sufficient credit for the payment of fair prices, and the file includes a certification of ownership and encumbrances, a cadastral certification of all plots included in the scope, and a reasoned valuation report by the architect Enrique Vilar Gantes.
The technical project was drafted by the engineer David Pardiñas Lamas and was definitively approved by the Resolution of June 23, 2025, of the General Directorate of Coast and Sea, by delegation of the Secretary of State for the Environment (reference RE 202590000000603, of September 30), after completing the public information process and incorporating sectoral reports. Subsequently, the document was rewritten to correct mere material errors, under article 109.2 of Law 39/2015.
Two decades of coastal paths
The City Council has been working on the recovery of the coastal edge since 2010, when the project “Environmental recovery of the coastal edge of Cabana de Bergantiños. Orixeira-Malecón section” was drafted, a work by the engineer Antonio J. Durán Maciñeira, within the framework of the recovery studies of the coastal paths of the Coast Demarcation in Galicia and the University of A Coruña.
The Resolution of May 21, 2012, of the Secretary of State for the Environment established the objective of the action: to recover the coastal edge between Orixeira and the Malecón, organize the transit easement, and facilitate and channel pedestrian access to the maritime-terrestrial zone through pedestrian itineraries. On this basis, the two sections already executed were drafted, Orixeira-O Curro and O Curro-Monte San Sebastián, and now the Monte San Sebastián-O Malecón section, which completes the route.
Sixty plots and 24,858.85 euros
The specific, individualized, and valued list initially approved affects approximately sixty plots of polygon 28, with a total value of 24,858.85 euros:
- Price of 16 euros per square meter for plots 1 to 10, the highest value ones: number 10, with 161 m² and 2,576 euros, and number 1, with 135 m² and 2,160 euros.
- Price of 1.67 euros per square meter for the rest, with two exceptions due to their surface area: plot 48, with 1,213 m² and 2,025.71 euros, and 143b, with 1,127 m² and 1,882.09 euros, owned by Devesa Langueiron, S.L.
- Plot 143a, with 623 m² and 1,040.41 euros, is listed under “unknown,” which is the reason for part of the public notification.
- Among the owners are Muebles Bergantiños, S.L., the Community of Heirs of Juan Graiño Amarelle, and dozens of individuals, several of whom own more than one plot.
Fifteen days to file objections
The exhibition period is fifteen business days counted from the last of the publications: the Official Provincial Gazette, the City Council notice board, and a widely circulated provincial newspaper. The file is available at the Urban Planning Department of the City Council, located at A Carballa, s/n, Cesullas, 15115 Cabana de Bergantiños, so that interested parties may file objections regarding the legitimacy of the occupation or disposal of the assets and regarding their material or legal status.
The agreement will be notified individually to each interested party and will also be published in the Official State Gazette, in accordance with Article 44 of Law 39/2015. Payment will be made solely to the registered owners of the domain or, in the case of unregistered properties, to the owner according to the justifying titles supplemented by negative certifications from the Property Registry; in all other cases, the amount will be deposited in the General Deposit Fund. As this is a procedural act, no appeal is applicable, although an optional appeal for reversal may be filed within one month. The mayor, José Muíño Domínguez, signs the announcement in Cabana de Bergantiños on October 13, 2026.
The expropriation completes the last pending section of a coastal path that has been under execution for more than a decade, so the owners of the affected plots must review the published list and present objections within the deadline if they disagree with the surface area, ownership, or assigned valuation. For the rest of the neighborhood, the procedure is the prelude to the opening for public use of a coastal stretch that until now had no continuous pedestrian access.
