The Governing Commission of the Barcelona City Council has definitively approved the statutes and the operational guidelines of the Compensation Board of the PMU-SSP3 of the Pallars-Fluvià-Pujades-Bac de Roda island of Barcelona, and has ratified its constitution. The agreement was adopted in the session of September 10, 2026, and is published in the Official Gazette of the Province of Barcelona on October 2, 2026, with the reference CVE 202610145806 and file Exp. 26G60.
The text complies with article 119.2 of Legislative Decree 1/2010, of August 3, which approves the Recast Text of the Urban Planning Law of Catalonia, and article 125.2 of Decree 305/2006, of July 18, of the Urban Planning Law Regulations. The statutes and guidelines had been definitively approved by the Plenary of the Municipal Council on March 27, 2026, and now incorporate the observations from the report of the Land Readjustment Department of the Municipal Institute of Urbanism dated May 9, 2026, formulated by owners representing more than 50% of the area’s surface.
The constitution is approved under article 119.4 of the same legal text and was formalized by public deed granted on October 29, 2025, before the notary Jesús Benavides Lima, under number 16,434 of his protocol. The file includes the initial approval by resolution of the First Deputy Mayor on May 20, 2026, and the reports from the Land Readjustment Department and the Valuations Department of the Urban Management Services Directorate, dated July 20, 2026. The announcement is signed by the general secretary, Jordi Cases i Pallarès, in Barcelona on September 16, 2026.
A preliminary step to registration
The agreement orders the transfer of the documentation prescribed by article 192 of Decree 305/2006 to the General Directorate of Urbanism of the Generalitat de Catalunya, for the purpose of registering the Board in the Registry of Collaborating Urban Entities. According to the statutes, the legal personality of the entity is acquired precisely at the moment of this registration.
Marta da Pena Gómez, the Director of Urban Management Services, is also designated as the Administration’s representative on the governing body. The agreement will be published in the Official Gazette of the Province, in the Municipal Gazette, on the corporation’s notice board, and in one of the widest-circulation newspapers in the province, and the Commission for Ecology, Urbanism, Mobility, and Housing will be notified.
What the Board does and how it is governed
The entity is of an administrative nature, has its own legal personality and full capacity, and acts under the guardianship of the Barcelona City Council as the acting administration. Its purpose is the management and execution of the SSP3 Urban Improvement Plan of the Pallars-Fluvià-Pujades-Bac de Roda block, delimited in the Specific Modification of the General Metropolitan Plan for a more inclusive and sustainable 22@, through the land readjustment system under the basic compensation modality. The registered office is established at Plaça Emili Mira i López 2, Barcelona, 08022, and its duration is indefinite until the fulfillment of its purposes.
The statutes, consisting of 46 articles, establish the following bodies and majorities:
- General Assembly: approves the land readjustment and urbanization projects, the budget and quotas, and appoints and removes the members of the Governing Council.
- Governing Council: composed of the president, the secretary, one member, and one member-treasurer, with re-electable three-year terms.
- Appointment of the president and the member-treasurer: requires the vote of owners with a share equal to or greater than 25%.
- Qualified majorities: 60% of the quotas to modify statutes and bases, incorporate urbanization companies, transfer real estate, contract loans, or dissolve the Board.
- Valid constitution of the Assembly: 50% of the quotas in the first call and 25% in the second.
Adhesions, deadlines and appeals
Owners who have not promoted the land readjustment may join the Board with equal rights and duties in the following cases:
- During the public information period following the publication of the agreement in the Official Gazette of the Province of Barcelona.
- Within the period fixed in the deed of constitution, which cannot be less than twenty calendar days.
- Within a period of one month from the notification of the agreement approving the constitution.
- If expropriation has begun, by paying the proportional part of the expenses with the corresponding legal interest.
Participation quotas are proportional to the area of the contributed properties and, once the land readjustment project is approved, to the value of the allocated properties. Payment of the quotas must be made within a maximum period of one month from the individualized request by the Board. Against the agreement, which ends the administrative route, an optional appeal for reversal may be filed within one month or a contentious-administrative appeal within two months.
The constitution of the Board is the step that enables the owners of the area to jointly manage the land readjustment and urbanization of the block, and conditions the schedule of future new construction licenses in the area. For the affected neighbors and owners, the agreement also establishes the rules for valuation, compensation, and relocation that will be applied during the execution of the PMU-SSP3.
