Balaguer appoints Mariona Vilella as Head of Human Resources of the Paeria

The Mayor’s Office of the Balaguer City Council has approved the appointment of Mariona Vilella Datsira as a civil servant in training in the category of senior technician and head of Human Resources of the corporation. The decision was adopted through Mayoral Decree 2026-2019, signed on October 27, 2026, and is published in the Official Gazette of the Province of Lleida no. 208, corresponding to October 30, 2026, with the official reference CVE BOP-2026_0_208_9000 (pp. 1-2).

The appointment closes the call identified with file 927/2026, intended for the selection of career civil service personnel to fill the position of head of Human Resources. The decree falls within the powers granted to the mayor’s office by Article 21 of Law 7/1985, of April 2, regulating the bases of the local regime, and Article 53 of Legislative Decree 2/2003, of April 28, which approves the Recast Text of the Municipal and Local Regime Law of Catalonia.

Proposal of the qualifying tribunal

The municipal government has resolved the process in accordance with the proposal of the qualifying tribunal, recorded in the minutes dated October 2, 2026. The appointment complies with what is provided in bases 10 and 11 of the call, which regulate the designation and the taking of possession of the awarded position.

The appointed person is listed with NIF 4805*****, partially anonymized in the text published in the official gazette.

Position conditions and assignment

The decree establishes the characteristics of the job position assumed by the new holder:

• Category: senior technician, head of Human Resources.
• Scale: general administration, management sub-scale.
• Professional classification group: A, subgroup A1.
• Status: civil servant in training.
• Dedication: full-time.

The taking of possession will take place at the Mayor’s office of the Balaguer City Council, before the Corporate Secretary, and will previously require compliance with the Spanish Constitution, the Statute of Autonomy of Catalonia, and the rest of the legal system.

One-month deadline and official publicity

The decree warns that the failure to take possession within one month from the notification and publication of the appointment entails the loss of all rights, except in cases of force majeure, which must be duly verified and assessed by the Administration.

The resolution is notified to the interested person and communicated to the Intervention Department and the Human Resources Department of the Balaguer City Council. Furthermore, the edict provides for publication in the Official Gazette of the Province of Lleida, the Official Gazette of the Generalitat de Catalunya, and the municipal electronic notice board, and the municipal government must report the decree to the Plenary in the next ordinary session to be held.

The text has been published under article 45.1 b) of Law 39/2015, of October 1, on the common administrative procedure of public administrations, and is electronically signed by the mayor, Lorena González Dios, dated October 27, 2026.

Appeals against the resolution

The resolution ends the administrative route, meaning that interested parties have two ways of challenging it:

• Optional appeal for reversal (recurso de reposición) before the same body that issued it, within a period of one month from the day following the notification or publication, in accordance with articles 123 and 124 of Law 39/2015.
• Contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Lleida, within a period of two months, according to articles 8 and 46 of Law 29/1998, of July 13, regulating the contentious-administrative jurisdiction.

After one month without an express resolution of the appeal for reversal, it may be understood as dismissed by administrative silence, and in no case may a new appeal for reversal be filed against the express or presumed resolution.

A key management position in the municipal organizational chart

The filling of the position of Head of Human Resources completes a command post within the structure of the Paeria of Balaguer, with direct responsibility for the management of municipal personnel. However, the status of trainee civil servant implies that the definitive consolidation of the position is subject to the probationary period provided for by the regulations and the effective taking of office within the term set by the decree.
