Baiona rectifica a Base 14 das bases de Técnico de Turismo

The City Council of Baiona has upheld the appeal for reversal filed by María José Pérez Barreiro and rectified Base 14 of the rules governing the selection process for Tourism Technician, altering the appointment and taking-office regime for applicants. The decision is materialized in Mayor’s Resolution No. 2026-2657, dated September 24, 2026, and published in the Official Gazette of the Province of Pontevedra (BOPPO) No. 198, dated October 14, 2026, within the Local Administration section, under the heading “Rectification of error in the rules for Tourism Technician of the Baiona City Council.”

The starting point: a typo in Base 14

The rules and the call for the selection process were approved by Mayor’s Resolution on July 15, 2026, published in BOPPO No. 143, dated July 29, 2026. The file is processed under number 2883/2024, under the personnel selection and position provision procedure, and the convened position is that of Tourism Activities Technician, with a start date of December 9, 2025.

Against that resolution, María José Pérez Barreiro filed an appeal for reversal requesting the review and amendment of a typo noticed in Base 14. The Mayor’s office upheld the request and declared the need to rectify the provision “to adapt it to legality and correct the detected error.”

From career civil servant to permanent-seasonal labor staff

The central change affects the title and content of Base 14. Where it previously read “Appointment and taking office,” it now reads “Formalization of the contract, call-up, and incorporation.” The consequence is a shift in the legal bond of the applicants:

  • The relationship ceases to be a civil service one: the original text spoke of appointment between the mayor and the applicant and the status of career civil servant.
  • The new wording establishes the formalization of a permanent-seasonal labor employment contract between the mayor of the Baiona City Council and the selected person.
  • The status of permanent-seasonal labor staff is acquired upon passing the selection process, the formalization of the contract by the competent body, and the official call-up with effective incorporation into the position.
  • The hiring resolution shall be adopted within one month from the expiration of the twenty business day period.
  • Until formalization and incorporation, the applicant will not be entitled to any economic remuneration.
  • Those proposed are subject, where applicable, to the prescriptions of Law 53/1984, of December 26, on incompatibilities of personnel in the service of public administrations.

The authorization for rectification is based on Article 109.2 of Law 39/2015, of October 1, on the common administrative procedure, and on Article 214 of Royal Decree 2568/1986, of November 28, which approves the Regulation on the Organization, Operation and Legal Regime of Local Entities. The Mayor’s competence to approve the bases and correct errors derives from Article 21.1.g) of Law 7/1985, of April 2, regulating the bases of the local regime.

The announcement of the formalization of the contract and the first call will be published on the electronic office of the Baiona City Council (http://baiona.sedelectronica.gal) and, if applicable, on the notice board. The resolution is also published in the BOPPO.

The rest of the call, intact

The agreement ratifies the rest of the terms, bases, and deadlines of the call that are not affected by the modification, which remain fully in force and unaltered. The rectification is therefore limited to Base 14.

The rectification has an immediate practical effect for the persons applying for the position: the process will no longer result in a civil service appointment, but in a fixed-discontinuous employment contract, with different call and incorporation conditions. For the applicants and for the municipal staff, the change clarifies the applicable legal regime before the selection is resolved.
