The P-four plot of Txalon Erreka in Azkoitia has been added to the protected housing agreement
Por FactBox Admin

The Basque Government, Azkoitia City Council, and the company Azkoitia Lantzen, S.A. have signed an amendment to the cooperation agreement of May 31, 2021, to add plot P-four of sector 10 in Txalon Erreka to the protected housing promotion area. The amendment was published in the Official Gazette of the Basque Country on October 27, 2026, issue number 205, via Resolution 99/2026, and it states that the city council will carry out the construction of the southern and eastern retaining walls in advance. The Basque Government will pay the cost after the works are completed, according to the work liquidation reviewed and validated between both parties.
The purpose of the agreement is to promote protected housing in the municipality of Azkoitia, and the signatories are the Department of Housing and Urban Agenda —which in 2021 was the Department of Territorial Planning, Housing and Transport—, Azkoitia City Council, and the municipal company Azkoitia Lantzen, S.A. The legal basis for the amendment is the exclusive competence granted by Article 10.31 of the Statute of Autonomy of the Basque Country in the field of urban planning and housing, and Law 3/2015, of June 18, on housing; the regime of agreements, meanwhile, is regulated by Law 40/2015, of October 1, on the legal regime of the public sector.
The strategic framework of the intervention is the Social Pact for Housing (2022-2036). According to the plan, in 2021 the Department of Housing and Urban Agenda had the land debt to build 3,000 protected homes, and it sets a second quantitative objective stating that the permanent protected housing park will exceed 12% of the main housing in the Basque Country by 2036, compared to 7.7% in 2021.
Why plot P-four was added
The amendment itself explains that after signing the extension, it was verified that plot P-four —registered property 12,546— had not been explicitly included in the scope of the original agreement. This plot was acquired by the housing department of the Basque Government through the payment-grant deed of November 3, 2017.
Three plots were foreseen in the 2021 agreement: P-one (number 1), P-two (number 2), and P-three (number 3). Now, the same conditions of the agreement will apply to plot P-four, with treatment equivalent to the other buildable plots.
Advance execution of retaining walls
The urbanization project ordered by Azkoitia City Council establishes phases, and the first phase includes the southern and eastern boundaries of plot P-four. The topography of the area makes the construction of retaining walls necessary to prevent embankments from forming on the plot; otherwise, the construction of the planned housing would incur additional costs.
To solve the problem, the city council will build these walls in advance, even though the tender for the construction works of the housing on the plot is not immediate. The Department of Housing and Urban Agenda has committed to paying the cost of these works later, according to the work liquidation reviewed and validated by both parties.
Chain of authorizations and chronology of proceedings
The modification is not a simple agreement: it has received authorizations from several organizations.
- July 17, 2025: The Joint Monitoring Committee agrees to draft the addendum and commission the city council for the execution of the wall.
- July 29, 2026: The plenary session of the Azkoitia City Council appoints Mayor Ana Azkoitia Urteaga, and on the same day, the Board of Directors of Azkoitia Lantzen, S.A. does so as well.
- September 8, 2026: The Governing Council of the Basque Government appoints Minister Denis Itxaso González.
- October 1, 2026: The addendum is signed, in the electronic headquarters, with the signatures of the mayor and the minister.
- October 8, 2026: Jon Iñaki Urbina García de Vicuña, Director of the Secretariat of Government and Relations with the Parliament, signs Resolution 99/2026, ordering the text to be published in the official gazette.
Background of protected housing in Azkoitia
The agreement itself lists the previous collaborations that have taken place in the municipality.
- November 8, 2005: Commitment agreement to promote protected housing in area 15 of Floreaga, between the Department of Housing and Social Affairs and the city council.
- January 16, 2009: Collaboration agreement for sector 10, named Txalon Erreka Ekialdea.
- May 31, 2021: Agreement between the three parties, which is now being modified.
- May 30, 2025: Extension of the agreement, as it was not possible to fulfill all commitments throughout its duration.
The final clause explicitly states that all other clauses not affected by the modification remain in force.
Regarding the practical outcome, the modification unlocks two problems: on one hand, it includes a plot in a formal promotion area for protected housing, providing legal certainty; on the other hand, it does not delay the first phase of the urbanization and avoids a cost increase for the housing, with the cost advanced by the city council at the moment and later assumed by the Government.
