Western Australia declares Planning Control Area 196 over Scarborough Beach Road

The Minister for Planning and Lands has approved the declaration of Planning Control Area 196 over Scarborough Beach Road, between Hinderwell Street and Odin Road and between King Edward Road and Main Street, in the Cities of Stirling and Vincent. The notice, published as item PL402 in the Western Australian Government Gazette No. 120 of Tuesday, 22 September 2026, also records the Minister’s approval of the revocation of Planning Control Area 166 under section 113 of the Planning and Development Act 2005. The declaration is signed by Sam Boucher, Secretary of the Western Australian Planning Commission (WAPC).

Purpose and scope of the control area

The WAPC states that Planning Control Area 196 is intended to protect land required for the future widening and upgrade of Scarborough Beach Road. The commission considers the control area necessary over the affected properties to ensure that no development occurs on the land which might prejudice that purpose until it may be reserved for Primary Regional Roads purposes in the Metropolitan Region Scheme.

The area is defined by nine WAPC plans, numbered 1.8287, 1.8288, 1.8289, 1.8290, 1.8291, 1.8292, 1.8293, 1.8294 and 1.8295. The notice carries the file references RLS/1222 and RLS/0979.

Duration, penalties and compensation

The declaration remains in effect for five years from the date of publication of the notice in the Government Gazette, or until revoked by the WAPC with the Minister’s approval, whichever is sooner. The revocation of Planning Control Area 166 takes effect on and from the date of the notice.

Under the notice, a person shall not commence and carry out development in a planning control area without the prior approval of the WAPC. The consequences set out in the gazette are:

  • A penalty of $200,000 for failure to comply with the approval requirement.
  • A further fine of $25,000 for each day during which a continuing offence continues.
  • Compensation payable in respect of land injuriously affected by the declaration.
  • Acquisition by the WAPC of land so affected, in the same circumstances and manner as if the land had been reserved in the Metropolitan Region Scheme for a public purpose.

The gazette directs readers to the Department of Planning, Lands and Heritage website, at its planning control areas document collection, for viewing of the documents. The notice appears in the Planning section of the gazette, which is published by the Government Printer for the State of Western Australia on Tuesdays and Fridays.

The declaration places an immediate approval requirement on owners and developers along a corridor spanning two local government areas, and signals that the corridor is being held for eventual reservation as a primary regional road. For affected property owners, the practical effect is that any works now require WAPC consent, while the compensation and acquisition provisions open a route to redress for land whose value is injuriously affected.
