Sale of social housing eased by a decree of August 25

Decree No. 2026-826 of August 25, 2026, signed under NOR VLOL2616578D, relaxes the conditions for the sale of housing by low-income housing organizations (HLM). The text, issued by the Ministry of the City and Housing, is published in the Official Journal of the French Republic No. 0200 of August 28, 2026.
It amends Article D. 443-34 of the Construction and Housing Code, which governs the conditions under which HLM organizations may transfer their housing to their tenants.
An extension of authorized sale cases
The decree expands the scope of situations in which the sale of HLM housing is permitted. At the end of the first paragraph of I of Article D. 443-34, the words “or i and j of 1° of I of Article 31 of the same code” are added, which refers to new hypotheses provided for by Article 31 of the code.
- The first paragraph of I of Article D. 443-34 is supplemented by the reference to i and j of 1° of I of Article 31 of the Construction and Housing Code.
- The second paragraph of I of Article D. 443-34 is deleted.
A relaxation of the regulatory framework
By deleting the second paragraph of I of Article D. 443-34, the decree eases the restrictive conditions that weighed on the transfer of housing by social landlords. This simplification aims to facilitate the sale of HLM housing, while remaining governed by the provisions of the code.
Execution and entry into force
The Minister of Action and Public Accounts and the Minister of the City and Housing are responsible, each in their respective capacities, for the execution of this decree. The text enters into force upon its publication in the Official Journal of the French Republic.
For HLM housing tenants, this relaxation expands the possibilities for home ownership by opening new hypotheses for sale by the landlord organizations.
