Valderredible suspende licencias en suelo rústico hasta aprobar la ordenanza de alturas

The Valderredible City Council has agreed to suspend the granting of licenses on rural land affected by the processing of the new municipal ordinance on maximum construction heights. The decision was adopted by the Plenary of the Corporation in an ordinary session on September 25, 2026, and is published in the Official Gazette of Cantabria no. 190, dated October 2, 2026, with the official reference CVE-2026-7585. The suspension will have a maximum duration of one year starting from the publication of the announcement.

The agreement is based on Article 89 of Law 5/2022, of July 15, on Land Use and Urban Planning of Cantabria, which enables the suspension of the granting of licenses while an instrument affecting the urban planning regime of the land is being processed. The announcement was signed in Polientes by the mayor, Luis Fernando Fernández Fernández, on September 28, 2026.

The suspension is not an isolated action: the same Plenary of September 25, 2026, initially approved the Regulating Ordinance of the documentation required to authorize heights exceeding the maximum permitted in constructions on rural land, published in the same issue of the gazette under the reference CVE-2026-7580. Both resolutions are part of the same municipal file.

A one-year suspension from publication

  • Scope: licenses on rural land affected by the processing of the height ordinance.
  • Maximum duration: one year, counted from the publication of the announcement in the Official Gazette of Cantabria.
  • Date of agreement: ordinary session of the Plenary on September 25, 2026.
  • Publication: BOC no. 190, of October 2, 2026, page 49071.
  • Official reference: CVE-2026-7585.

The height ordinance, open for public consultation

The ordinance that motivates the suspension was initially approved by the Plenary on September 25, 2026, and is now subject to public consultation for a period of thirty business days, starting from the day following the publication of the announcement. The procedure complies with Article 49 of Law 7/1985, of April 2, regulating the Bases of Local Regime.

During this period, legitimate interested parties may submit any allegations or claims they deem appropriate. The file is available for public inspection at the secretariat of the Valderredible City Council. If no allegations are submitted, the initial agreement will be considered final. The announcement is published with the reference CVE-2026-7580, on page 49375 of BOC no. 190.

What this implies for owners and developers

  • Those planning to apply for construction licenses on rural land within the municipal district will see their processing halted for the duration of the suspension.
  • The measure specifically affects licenses linked to the regulation of heights exceeding the maximum permitted.
  • The one-year period operates as a legal limit: once that time has elapsed since publication, the suspension expires.
  • The final approval of the ordinance—or its automatic elevation if there are no objections—will establish the new framework of required documentation.

For a rural municipality like Valderredible, the combination of the license suspension and the new ordinance sets the building rules for rural land over the coming year. Owners and developers with ongoing projects must wait for the resolution of the file or adjust their applications to the documentation required by the ordinance currently being processed.
