Ecological Transition dismisses the Umiko solar park and archives the file

The General Directorate of Energy Policy and Mines has dismissed the application for prior administrative authorization for the “Umiko” solar photovoltaic park, with an installed capacity of 46.5 MW, promoted by Energía Inagotable de Umiko, SL in the municipality of Tauste, in the province of Zaragoza, and has agreed to archive file PFot-752. The resolution, signed in Madrid on August 31, 2026, by the director general Manuel García Hernández, is published in the Official Gazette of the Historical Territory of Álava no. 110, of September 25, 2026, within section III of other public administrations.

The ruling corresponds to the Ministry for the Ecological Transition and the Demographic Challenge, through the Secretary of State for Energy, and is adopted under article 53 of Law 24/2013, of December 26, on the Electricity Sector, and Royal Decree 1955/2000, of December 1. The file began on July 27, 2021, when the promoter requested prior administrative authorization for a plant of 49.50 MWp / 46.50 MWn.

The processing was consolidated on August 10, 2021, with the “Tara” park under file PFot-752AC, affecting the provinces of Zaragoza, Navarra, La Rioja, Álava, and Burgos. On June 5, 2025, the general directorate agreed to the deconsolidation and separate resolution of “Umiko” (46.5 MW) and “Tara” (23.7 MW), such that the project began to be processed under code PFot-752.

A favorable environmental statement that never arrived

The General Directorate of Environmental Quality and Assessment formulated on November 24, 2023, the environmental impact statement for the “Tara and Umiko photovoltaic parks and their evacuation infrastructures,” published under reference BOE-A-2025-1551. The project had obtained access and connection permits through a feasibility report at the Jundiz 220 kV substation, owned by Red Eléctrica de España, SAU.

Those permits expired on October 29, 2023, as a favorable environmental impact statement had not been obtained within the deadline, according to the milestones of Royal Decree-law 23/2020, of June 23, which requires 31 months for the environmental statement and 34 months for the prior administrative authorization. Red Eléctrica de España, SAU notified the ministry of the expiration on December 19, 2023.

Hearing without response and archiving at the promoter’s request

On June 13, 2025, a hearing process was granted regarding the proposal for dismissal, with a period of fifteen business days that passed without a response from the promoter. On June 29, 2026, Energía Inagotable de Umiko, SL submitted a written request asking for the archiving of file PFot-752, relating to the park and its evacuation infrastructure.

The resolution recalls that the administrative authorization for generation facilities cannot be granted without valid access and connection permits, and that Royal Decree 1183/2020, of December 29 requires a financial guarantee of 40 euros per installed kW, executable immediately upon the expiration of the permits.

For developers, the case confirms that a favorable environmental impact statement within the deadline is a material, not formal, condition for keeping a photovoltaic project alive.
