The Torremayor City Council has declared a situation of imminent urban ruin for the property with cadastral reference 3789413QD1038N0001QY, located at number 5 Braulio Tamayo Street, in that town of the province of Badajoz. The measure was adopted through Mayoral Resolution 2026-0258, dated September 18, 2026, and is made public in the Official Gazette of the Province of Badajoz number 181, dated September 22, 2026, via Announcement 3679/2026. The agreement requires the owner to demolish the building within 48 hours.

The publication is supported by Article 44 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, which provides for notification by announcement when the interested parties of a procedure are unknown, without prejudice to its publication in the BOP and on the municipal notice board. The resolution is based on the technical report of August 31, 2026, incorporated into the file, whose conclusions support the declaration.

Extreme deterioration and risk to the public road

The technical report finds that the building presents a state of extreme deterioration, with collapse of the roof and a generalized loss of load-bearing capacity. It adds that there is a real, serious, and immediate risk to the safety of people and property, with a particular impact on the street where the property is located due to the state of its facade. The document concludes that a mere execution order is not appropriate due to the absence of minimum safety conditions.

Precautionary measures and urgent demolition

As necessary measures to avoid damage to people and property, the resolution orders:

  • Maintenance and renovation of the perimeter fencing to protect pedestrian and vehicular traffic on Braulio Tamayo Street.
  • Adequate signage in the risk area.
  • Restriction of access to the immediate risk areas of the surroundings.
  • Provisional measures to prevent uncontrolled collapses.
  • Disconnection and removal of telephony and electricity lines running through the facade, as well as other services that may be affected.
  • Urgent and controlled demolition of the property, as an exclusive measure to eliminate the imminent risk on the public road and in adjacent buildings.

The supply companies will be responsible for budgeting and, if applicable, executing the security measures they deem appropriate to avoid risks during the demolition works. Both the demolition and subsequent actions are detailed in the project drafted for this purpose, signed and endorsed by a competent technician.

48-hour deadline, costs, and appeal process

Given the immediate danger posed by the situation, the owner or holder of real property rights of the building is required, under their own responsibility, to carry out the demolition and the remaining actions detailed in the technical report within 48 hours. Once this period has elapsed, the municipal Administration may proceed to the subsidiary execution provided for in Article 102 of Law 39/2015, charging the costs to the owner.

The expenses will likewise be charged to the holder, with the budget contained in the demolition project—endorsed by COADE on September 11, 2026, under file 26E001968—as well as the professional fees for its drafting, serving as a provisional settlement, all without prejudice to the final settlement. This resolution exhausts the administrative route and may be optionally appealed for reversal within one month before the same body that issued it, or directly through a contentious-administrative appeal within two months before the Contentious-Administrative Court, in accordance with Articles 123 and 124 of Law 39/2015 and Article 46 of Law 29/1998, of July 13. The document appears signed by the mayor, Manuel Estribio Sánchez.

The declaration of imminent ruin places the residents of Braulio Tamayo Street before an urgent municipal intervention: the City Council assumes the possibility of subsidiary demolition if the owner does not act within two days and will transfer the bill to the property holder. The file also provides for entries in the Property Registry, which links the status of the property to future transfers.
