Torrebesses aprova l'ordenança de civisme i obre trenta dies d'informació pública

The Plenary of the Torrebesses City Council initially approved on October 9, 2026, the Municipal Ordinance on Civility, Citizen Coexistence, and Good Governance, a text of 119 articles that regulates the use of public spaces and defines infractions with fines of up to 3,000 euros. The agreement is published in the Official Gazette of the Province of Lleida (BOP) no. 208, of October 30, 2026, through the mayoral resolution of file 402/2026, which subjects the regulation to public information and a hearing for interested parties for 30 business days.

The resolution, which bears the official reference BOP-2026_0_208_8957 and occupies pages 1 to 36 of the gazette, complies with the plenary agreement and orders the publication of the announcement in the BOP, on the municipal notice board, and on the city council’s electronic headquarters, so that any person may examine the file and submit allegations. The text is framed within the regulatory power that articles 4.1.a) and 25 of Law 7/1985, of April 2, regulating the bases of the local regime, recognize for municipalities, and within the procedure of articles 49 and 70.2 of the same legal body and 178 of the Recast Text of the Municipal and Local Regime Law of Catalonia, approved by Legislative Decree 2/2003, of April 28.

A text of 119 articles structured in 21 titles

The ordinance deploys its regulation in 21 titles and 119 articles, in addition to six annexes, and applies to the entire municipal district and to all natural and legal persons who are present or carry out activities therein, regardless of domicile or nationality. The areas it covers are:

  • Use of public spaces, assets, and facilities, and occupation of the public road.
  • Cleaning, waste, vacant lots, and sanitation, with specific provisions for the door-to-door collection system.
  • Pets, including feline colonies and the prohibition of feeding animals on public roads.
  • Noise pollution, with a general rest period between 10:00 PM and 7:00 AM.
  • Vehicles, mobility, bicycles, and personal mobility vehicles.
  • Universal accessibility and protection of people with disabilities.
  • Conservation of buildings, facades, and vacant lots, and protection of municipal heritage.
  • Activities, establishments, shows, and major festivals.

Fines of up to 3,000 euros according to severity

The sanctioning regime classifies infractions as minor, serious, and very serious and sets, as a general rule, these amounts:

  • Minor infractions: up to 750 euros.
  • Serious infractions: up to 1,500 euros.
  • Very serious infractions: up to 3,000 euros.

Behaviors classified as minor include the slight deterioration of urban furniture, throwing waste in unauthorized places, failing to collect animal waste, unauthorized graffiti, and domestic noise of a minor nature. Serious behaviors include causing significant damage to municipal heritage, the unauthorized occupation of public roads with significant impact, behaviors that seriously disrupt coexistence, and serious risks to safety or health. The grading of the sanction will consider criteria such as intentionality, recidivism, the benefit obtained, the risk generated, and the spontaneous repair of the damage, and the fine is compatible with the obligation to restore the altered situation and compensate for damages.

Thirty business days to appeal before final approval

The public information period is thirty business days and begins the day after the publication of the announcement in the BOP. According to the resolution, if no claim or suggestion is presented during this period, the initial approval agreement will become final without the need for a new express agreement, in accordance with article 178.1.c) of the referred Catalan text. If any are presented, they must be resolved by the Plenary, which will adopt the corresponding final approval agreement.

The initial approval corresponded to the Plenary by simple majority, as the ordinance is not part of the urban planning plans and instruments, tax ordinances, or the organic regulation of the corporation, cases that article 65.2 of Decree 179/1995, of June 13, reserves for an absolute majority. Once it is final, the text must be published in full in the BOP and will not enter into force until the legally established period has elapsed. The regulation also includes instruments for promoting civility, citizen participation, and mediation to resolve coexistence conflicts.

The new ordinance is the first complete municipal regulation on civility in Torrebesses and directly affects all residents, business owners, and owners of plots and properties in the municipality, who will have to adapt habits such as waste collection, pet ownership, or construction works to the new rules. The public information period is now the only window to modify the text before it becomes final.
