Tolmin Council Clears Zoning Deviation for VDC Tolmin Development

The Občinski svet Občine Tolmin has confirmed location check LP 17, granting an individual deviation from the maximum permitted building-coverage factor in spatial unit TO-66 so that the integrated development investment VDC Tolmin can proceed. The decision was taken at the council’s 34th session on 13 October 2026 and published in Uradni list Republike Slovenije No. 1671/2026 of 15 October 2026 under official reference EDA 2026-5881455000-0021. The measure takes effect on the fifteenth day after publication.

The instrument is a lokacijska preveritev — a location check — adopted under Articles 135 and 138 of the Zakon o urejanju prostora (ZUreP-3) and Article 29 of the Zakon o lokalni samoupravi (ZLS), together with Article 19 of the Statut Občine Tolmin. The decision, numbered 351-0067/2026, is signed by the mayor of Občina Tolmin, Alen Červ, and dated in Tolmin on 13 October 2026.

What the location check confirms

Article 1 of the decision confirms the location check registered under identification number ID 7657 in the register of spatial acts. It covers buildings already constructed on six cadastral parcels in the cadastral municipality of k.o. 2248 Tolmin:

• 950/1, 950/2 and 950/3;
• 949/1, 949/2 and 949/3.

Under the Odlok o občinskem prostorskem načrtu občine Tolmin (OPN Tolmin) — published in Uradni list RS No. 78/12, with binding interpretations in 37/15 and 184/20, first amendments in 94/22 and a technical update in 47/25 — the site lies within the spatial planning unit EUP TO-66, whose designated land use is osrednja območja centralnih dejavnosti (CU), the central-activities areas.

The deviation granted

Article 2 allows an individual departure from the spatial implementation condition governing the maximum permissible building-coverage factor (FZ) on the parts of the site carrying the more detailed CU designation. The council states the purpose explicitly: to make possible the implementation of the integrated development investment VDC Tolmin. The decision does not alter the underlying land-use designation; it relaxes one implementation parameter for the defined area of the location check.

Publication, notification and entry into force

• Under Article 138(7) of ZUreP-3, the adopted decision is published in the spatial information system together with the elaboration and the opinions of the spatial planning authorities.
• The decision is forwarded to the Upravna enota Tolmin and to the Ministrstvo za okolje in prostor.
• It enters into force on the fifteenth day after publication in Uradni list Republike Slovenije.

The notice appears in the official gazette issued by the Služba Vlade Republike Slovenije za zakonodajo (ISSN 1580-3074, year XXXVI).

The clearance removes a single planning constraint standing in the way of the VDC Tolmin scheme, and it matters beyond the investor: owners of the six parcels in and around EUP TO-66 gain certainty about what may be built there, while the Upravna enota Tolmin and the environment ministry receive the file as the authorities responsible for subsequent permit decisions. Because the deviation is individual and tied to a defined area, it does not change the coverage rules that apply elsewhere in Tolmin.
