Teruel anula el convenio urbanístico de la ampliación de Las Viñas

The Plenary of the Teruel City Council has declared null and void the agreement of November 3, 2025, by which it approved the Urban Planning Agreement for Sector 2 SUP “Ampliación las Viñas”, following the opinion of the Consultative Council of Aragon. The plenary agreement was adopted in an ordinary session on October 5, 2026, and is published in the Official Gazette of the Province of Teruel no. 201, of October 20, 2026, under reference 2026-2987.

The annulled agreement bound the Teruel City Council with the Compensation Board of the Single UE of Polygons 4, 5, 6, and 8 of Sector 2 SUP “Ampliación las Viñas” of the city’s General Urban Development Plan, and was processed within administrative file 64/2024/PLANURB. The decision is part of an ex officio review procedure for null acts, regulated in Article 106 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

The opinion that deactivated the agreement

The Plenary took note of the allegation presented by the Compensation Board itself and agreed to initiate the ex officio review of the agreement approving the convention, for the reasons set forth in the legal grounds of the proposed report that serves as the basis for the resolution.

On that basis, and in accordance with opinion no. 82/2026 issued by the Consultative Council of Aragon, the City Council declared the nullity of the approval agreement and ordered the archiving of the proceedings contained in file 64/2024-PLANURB.

Affected parties and notifications

The agreement details the recipients of the resolution and the procedures that the City Council must execute:

  • Notification to the Compensation Board of the Single UE of Polygons 4, 5, 6, and 8 of Sector 2 SUP “Ampliación las Viñas”.
  • Notification to the owners of the plots not adhered to the Compensation Board.
  • Specific communication to the submitters of the allegations, indicating the relevant legal actions.
  • Transfer to the delegated councilor for City and Sustainability, the Mayor’s Office, the director of the Office for Adaptation and Revision of the Teruel PGOU, and the Provincial Urbanism Council.
  • Submission of a certified copy of the resolution to the Consultative Council of Aragon, pursuant to Article 14.3 of Decree 148/2010, of September 7, which approves the Regulations for the Organization and Operation of the aforementioned body.
  • Publication of the agreement in the Official Gazette of the Province of Teruel.

Deadlines and appeal process

The agreement concludes the administrative process; therefore, a contentious-administrative appeal may be filed directly before the Contentious-Administrative Chamber of the High Court of Justice of Aragon within two months, starting from the day following the notification of the express resolution.

This period is in accordance with articles 10.1.b), 25.1, and 46.1 of Law 29/1998, of July 13, regulating Contentious-Administrative Jurisdiction, without prejudice to the fact that interested parties may exercise other actions in defense of their rights and legitimate interests.

The document appears signed in Teruel on October 19, 2026, by delegation of the general secretary, by the technician of the Planning and Management Unit, Manuel S. Antón Benayas.

The annulment renders ineffective the planning instrument that ordered the development of polygons 4, 5, 6, and 8 of the sector and returns the initiative to the municipal level, which must reorganize the action through the PGOU (General Urban Development Plan). For the affected owners, the resolution opens a scenario of uncertainty regarding the layout of their plots and, at the same time, the possibility of appealing to the courts within two months.
