Superintendencia excluye a liquidador Nelson Saldía por no renovar su garantía

The Superintendency of Insolvency and Entrepreneurship (Superir) excluded Nelson Fabián Saldía Arteaga from the Roster of Liquidators for failing to renew his performance bond. The decision is contained in exempt resolution No. 8,961, dated April 16, 2026, published in the Official Gazette No. 44,568, dated October 7, 2026, Section I, pages 1 to 3 (CVE 2880929). The administrative act was signed by Johana Álvarez Ahumada, Acting Superintendent of Insolvency and Entrepreneurship (S).

The measure is based on numeral 2 of article 18 of Law No. 20,720, in relation to articles 16, 31, and 32 of the same legal body, which require the provision of the performance bond “in a timely and proper manner” as a requirement for incorporation and permanence in the registry. Superir also invokes the final paragraph of article 4 of General Character Norm No. 10, dated December 31, 2019, according to which liquidators suspended for failing to renew their bond and whose delay exceeds thirty business days from the expiration of the last bond “shall be excluded from the respective roster.”

The agency qualifies this bond as “an essential requirement for incorporation and permanence,” because it ensures to the interested parties of each insolvency proceeding and to the Service itself a commitment to the correct execution of the regulations.

Chronology of the breach

  • May 5, 2017: exempt resolution No. 2,990 incorporates Saldía Arteaga into the Roster of Liquidators.
  • May 30, 2024: exempt resolution No. 7,383 confirms his permanence in the registry.
  • December 23, 2025: exempt resolution No. 25,571 suspends him from assuming new insolvency proceedings for failing to renew the bond.
  • February 12, 2026: exempt resolution No. 3,401, notified on February 17, presents the grounds for exclusion and gives him 5 business days to submit a defense.
  • February 23, 2026: he submits his defense, acknowledges the delay, and requests a 30-business-day extension (Superir Entry No. 31,218, dated March 2, 2026).
  • March 18, 2026: exempt resolution No. 6,661, notified on March 19, considers the defense submitted and exceptionally grants him 5 days to provide the bond.
  • April 16, 2026: exempt resolution No. 8,961 orders the exclusion, as no response was received from the liquidator.

Immediate effects and proceedings under his charge

The resolution instructs Saldía Arteaga to establish a new performance bond in accordance with Article 16 of Law No. 20,720 within 10 business days from notification, under penalty of initiating an administrative sanctioning procedure. It is also established that they are suspended from assuming new insolvency proceedings from the notification of the act.

The document details 26 active liquidation proceedings under their charge, including:

  • C-2718-2017, 1st Civil Court of Chillán, Claudia Andrea Varela Rodríguez (voluntary liquidation).
  • C-10548-2018, 22nd Civil Court of Santiago, Clínica Regencell SpA (forced liquidation).
  • C-2095-2019, 3rd Civil Court of Antofagasta, Fénix Servicios Industriales SpA.
  • C-2752-2022, 1st Civil Court of Antofagasta, Inversiones IG SpA.
  • C-4567-2024, 2nd Civil Court of Antofagasta, Empresa de Recursos Humanos Inherentes a Seguridad Privada Grupo Más Integral SpA.
  • C-347-2025, 2nd Court of Coronel, Fernando Javier Gallegos Apablaza.

The exclusion applies “without prejudice to their responsibility in the management of the active proceedings under their charge and any other obligation for the functions already assumed.” The liquidator must also comply with Superir Instruction No. 1, of 2024, regarding liquidators who cease their duties prematurely, the consolidated text of which was established by exempt resolution No. 7,164.

Appeal Process

The Complaint Resource provided for in Article 19 in relation to Article 31, both of Law No. 20,720, is applicable against the resolution. Notification will be carried out via certified mail to the address registered with the Superintendency.

The exclusion leaves creditors and debtors of over twenty insolvency processes without a liquidator eligible to assume new appointments, while the professional maintains the administration of the cases already assigned and the obligation to establish a new guarantee to answer for their management.
