Seville removes the Santa Elena 16 estate from the Nervión Catalogue

Por FactBox Admin

Sevilla descataloga la finca de Santa Elena 16 del Catálogo de Nervión

The Seville City Council has definitively approved the decataloging of the property located at 16 Santa Elena Street, in the Nervión neighborhood, which is thus excluded from the Nervión Neighborhood Catalog and loses its heritage protection. The agreement was adopted by the Municipal Plenary in the session of September 17, 2026, and is published in the Official Gazette of the Province of Seville No. 201, dated October 16, 2026, with the official reference BOP-SE-2026-201029.

The decision consists of a Specific Modification of the Nervión Neighborhood Catalog regarding that property, which until now had “preventive cataloging.” The Catalog was definitively approved by the Plenary on March 29, 2019, and its objective is the protection of the neighborhood’s original architecture and, especially, that which is representative of the so-called regionalist style. Preventive cataloging is defined as a prior precaution until sufficient information is provided about the protected element, the analysis of which concludes in the assignment of one of the four protection levels used—“A”, “B”, “C”, and “D”—or in its non-cataloging.

The process began with the initial approval by the Governing Board of the City of Seville in the session of June 26, 2026, in accordance with the technical and legal reports issued on June 12 and 15, 2026, by the Planning and Urban Development Service. The document was subject to public consultation for 20 days via an announcement in the Official Gazette of the Province No. 127, dated July 3, 2026, and on the web portal of the Urban Planning and Environment Management, a process in which no objections were submitted. The final proposal was submitted to the Plenary by the Governing Council of the Urban Planning and Environment Management, meeting on September 1, 2026, and signed by the Deputy Mayor for Urban Planning, Environmental Protection, Heritage, and Housing, Juan de la Rosa Bonsón, exercising the powers conferred by the Mayor’s Resolution No. 921, dated September 30, 2024.

Technical arguments for the decataloging

The technical report concludes that the cataloging of the property is not appropriate, based on the following reasoning:

  • The construction date of the building cannot be dated, due to a lack of information in the Municipal Archive and aerial photographs prior to 1954.
  • The property has undergone a significant architectural transformation.
  • It lacks unique architectural or typological elements that could be subject to specific protection.
  • It cannot be considered a significant sample of any specific architectural style.
  • It is not mentioned in any publication or manual on the subject.

These conclusions are adopted in application of the cataloging criteria established in section 2.2 of the Catalog Report.

Deposit, publication, and appeals

The agreement comprises three pronouncements: definitively approving the modification, depositing and registering the planning instrument in the regional and municipal registries, and publishing the agreement in the Official Provincial Gazette and on the Management’s web portal. The instrument was deposited in the Municipal Registry of Urban Planning Instruments as an Accessory Annotation of the Consolidated Text of the General Urban Development Plan on October 6, 2026, and in the Regional Registry under No. 8,026.

The act is final in administrative proceedings. A contentious-administrative appeal may be filed against it before the Contentious-Administrative Chamber of the High Court of Justice of Andalusia within two months starting from the day following its publication, pursuant to Article 114 of Law 39/2015 and Article 46 of Law 29/1998. The announcement is signed by the Secretary General of the Plenary, Luis Enrique Flores Domínguez, dated October 7, 2026.

Impact on owners and urban heritage

The resolution directly affects the ownership of the property, which recovers the ordinary urban planning regime upon the expiration of the precautionary measure that limited its intervention possibilities. For defenders of urban heritage, the measure represents a net loss in the protected inventory of Nervión, a neighborhood whose Catalog was designed precisely to preserve its regionalist architecture. The file is closed without citizen objections and with the instrument already registered in the municipal and regional registries; therefore, any challenge must be brought before the contentious-administrative jurisdiction within the indicated period.
