SESPA excludes fourteen applicants from the competition for 299 Nursing positions
Por FactBox Admin

The Health Service of the Principality of Asturias (SESPA) has definitively excluded fourteen people from the competitive examination called to fill 299 positions of permanent statutory staff in the category of Nurse. The decision is contained in the Resolution of October 8, 2026, from the organization’s Directorate of Professionals, published in the Official Gazette of the Principality of Asturias (BOPA) No. 208, of October 27, 2026, with official reference 2026-08478. Those affected already held the status of permanent statutory staff in the same category for which they were applying, which disqualifies them from participating in the process.
A call for 299 positions opened in May 2025
The selection process was launched through the Resolution of April 28, 2025, from the SESPA Management Directorate, published in the BOPA of May 13, 2025. That call organized a competitive examination for access to 299 permanent statutory staff positions in the category of Nurse, one of the largest stabilization offers of the Asturian health system.
The second base, section 2.1.1, letter e), of the call establishes the following requirement for applicants:
- Not to be the holder of a position in the same category and/or specialty for which they are applying.
- The prohibition extends to the entire National Health System, regardless of the applicant’s administrative situation.
- The equivalence of categories is determined according to Royal Decree 184/2015, of March 13, and its subsequent modifications.
According to the resolution, the Directorate of Professionals noted the possibility that this requirement might be missing and proceeded to verify the matter. The verification confirmed that the persons listed in Annex I hold the status of permanent statutory staff in the category of Nurse at SESPA.
Incurable defect and forfeiture of rights
The fourth base, point 4.3, of the call provides that, if at any time after the approval of the lists of admitted and excluded applicants, inaccuracy or falsehood is detected in the applications that would be cause for exclusion, this will be considered an incurable defect and it will be proposed to the convening body to resolve the exclusion.
The document also invokes Article 128 of Law 7/2019, of March 29, on Health of the Principality of Asturias, which attributes to the Management Directorate of SESPA the appointment of the organization’s permanent statutory staff. Having established the non-compliance, the resolution declares the forfeiture of the rights derived from the participation of the affected parties in the selection process.
The fourteen excluded applicants
Annex I, titled “exclusion of applicants,” identifies the affected persons by surname and name, with the identification number partially hidden:
- Covadonga Areces Fernández
- Alba Cotarelo Prieto
- Gema Fernández Novo
- Ana García Fernández
- David Guiote Pertierra
- Mario Jiménez Carlón
- Javier Marcos Tamargo
- Cristina Menéndez García
- Cristina Muñoz Azcárate
- Sofía Pérez Niño
- Flor M. San Martín Baragaño
- María Sánchez Carballo
- Paloma Suárez Pazos
- Susana Suárez Sánchez
The resolution was signed in Oviedo on October 8, 2026, by the Managing Director of SESPA and consists of two pages in the regional bulletin.
Administrative appeal within one month
Against the resolution, which does not exhaust the administrative route, interested parties may file an administrative appeal (recurso de alzada) before the Hon. Health Councilor within a period of one month starting from the day following its notification. The text refers to Article 27 of Law 2/1995, of March 13, on the Legal Regime of the Administration of the Principality of Asturias, and to Article 121 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.
The exclusion purges the census of applicants for a process called to reinforce the Nursing staff of the Asturian health system and clarifies one of the most discussed rules of the stabilization calls: those who are already permanent staff in the same category cannot compete for the same positions. For the candidates, the resolution also establishes an explicit criterion regarding the ex officio verification of requirements and the consideration of inaccuracy as an incurable defect.
