Sedatu modifica las Reglas de Operación del Programa de Vivienda Social 2026

The Secretariat of Agrarian, Territorial and Urban Development (Sedatu) modified the Operating Rules of the Social Housing Program for the 2026 fiscal year through an agreement signed by its head, Edna Elena Vega Rangel, and published on Tuesday, November 3, 2026, in the Official Gazette of the Federation (DOF). The instrument, titled Agreement by which the Operating Rules of the Social Housing Program for the 2026 fiscal year are modified, will enter into force the day after its publication, that is, November 4. Consequently, the criteria for access and the exercise of support received by program beneficiaries and executors are adjusted.

The regulatory framework of the adjustment

Sedatu based the measure on Article 4, ninth paragraph, of the Political Constitution of the United Mexican States, as well as the Housing Law, which mandates that public policies and programs promote financing, subsidy, and prior savings schemes for housing in its various types and modalities. The agreement also invokes Articles 27, 28, 29, and 30 of the Federal Expenditure Budget Decree for the 2026 fiscal year, which allocated a specific amount to the program, and Articles 1, 74, and 75 of the Federal Law on Budget and Fiscal Responsibility.

The original Operating Rules had been issued on December 31, 2025, when the agreement corresponding to the 2026 fiscal year was published in the morning edition of the DOF. The new instrument replaces that text: its SOLE article provides that the Rules “are modified” to comply with what is established in the annex of the agreement, without changing the name or the fiscal year of the program.

The legal bases supporting the decision are:

  • Article 4, ninth paragraph, of the Political Constitution of the United Mexican States, and General Comment No. 4 of the Committee on Economic, Social and Cultural Rights.
  • Articles 1, 74, and 75 of the Federal Law on Budget and Fiscal Responsibility, and 47, 48, and 58 of the Federal Law of Parastatal Entities.
  • Articles 5, 8, 19, 23, 71, 86, and 87 of the Housing Law, and 1, 2, 3, 5, 6, 8, 10, 18, 19, and 26 of the General Law for Social Development.
  • Articles 27 to 30 of the Federal Expenditure Budget Decree for the 2026 fiscal year and Article 7, fraction I, of the Organic Statute of the National Housing Commission.

Approval by the National Housing Commission

The preamble of the agreement specifies that the Governing Board of the National Housing Commission, in its Sixth Extraordinary Session held on July 29, 2026, approved the modification through Agreement number JG-6E-290726-04. This collegiate support is what allows the Secretariat to adjust the program rules without issuing a completely new regulation.

The preamble of the document, on the other hand, invokes Agreement number JG-10E-20112025-02, adopted during the Tenth Extraordinary Session of the same Governing Board, along with the Organic Statute of Financiera para el Bienestar, as its basis. The published text does not explain the relationship between both references.

Validity and content of the annex

The agreement consists of a single article and a single transitory provision, which sets the entry into force for the day following its publication in the DOF. It was signed in Mexico City on October 28, 2026, by secretary Edna Elena Vega Rangel.

The details of the modifications are not reproduced in the body of the published agreement: the text refers to the respective annex, available on the DOF portal along with the official link to the document. The specific criteria for access, eligibility, and exercise of the supports that will apply to the beneficiaries and the program executors during the remainder of the 2026 fiscal year must be consulted through that channel.

With its entry into force on November 4, the modified rules will govern the final stretch of the budget year, without the agreement providing for a special transitory regime for procedures already underway.

The adjustment is important because the Operating Rules define who can receive program supports and how their exercise is verified, such that any change directly affects the individuals and entities processing an application or executing social housing works in the country. Upon publication in the Diario Oficial de la Federación, the modification is mandatory and enforceable as of November 4, 2026.
