Por FactBox Admin

The Insular Council of Ibiza and the City Council of Santa Eulària des Riu have formalized an agreement whereby the council assumes the tendering, contracting, and material execution of the improvement works for the Can Marçà bypass, on the EI-200 road. The agreement is published in the Official Gazette of the Balearic Islands (BOIB) no. 125, dated October 3, 2026, Section III, p. 53863, with document number 9911. The Council will contribute a maximum amount of 944,391.17 euros.
The agreement was signed electronically on September 21, 2026, and the document is closed and dated in Ibiza on September 30, 2026, signed by the head of the Road Infrastructure service, Antonio Marí Noguera. The signing parties are the president of the Insular Council of Ibiza, Vicent Marí Torres, and the mayor of Santa Eulària des Riu, María del Carmen Ferrer Torres.
A legal framework for inter-administrative collaboration
The text is based on article 120.1 of Law 4/2022, of June 28, on insular councils, and article 68.1 of Law 20/2006, of December 15, municipal and local regime of the Balearic Islands, which allow for the signing of agreements between administrations without the transfer of ownership of the competence. Competence over roads corresponds to the Council according to article 70.15 of the Statute of Autonomy of the Balearic Islands and Law 16/2001, of December 14.
The specific basis is article 5.5 of Law 5/1990, of May 24, on roads of the Autonomous Community of the Balearic Islands, introduced by article 60 of Law 7/2024, of December 11, which allows agreements for the drafting and execution of works regardless of the ownership of the road. The project was already forwarded to the City Council by official letter from the executive councillor for Territory, with RGS 2025016561, dated September 19, 2025.
What the bypass improvement includes
The works will be carried out on the EI-200 road, between kilometer point 3+700 and 4+400, on public domain land owned by the Council. The project provides for:
- Improving road safety and reorganizing access points.
- Executing the necessary surface drainage works.
- Renewing the lighting.
- Installing a signalized pedestrian crossing.
- Executing accessible pedestrian itineraries on both sides of the road.
- Enabling spaces designated for waste collection.
- Constructing two bus stops, one on each side of the road.
Financing, deadlines, and monitoring
The Council’s contribution, which is a maximum amount, is charged to item 4530.76203 of the 2027 budget and is subject to the existence of adequate and sufficient credit. It covers the project’s execution budget, any modifications, expropriations or land transfers, project management, and other expenses. Any increase exceeding this limit will be borne by the City Council.
Payments will be made by account transfer within one month from the date the city council provides the supporting documentation, and the justification for the entirety of the work must be presented four months before the end of the term. The agreement has a term of two years from the electronic signature, with possible express extensions.
A monitoring commission is established, consisting of:
- Presidency: the president of the Insular Council of Ibiza.
- Secretariat: a Council official, with voice but without vote.
- Members: an executive councillor of the Council, a councillor and a technician from the City Council, and a technician from the Council.
The resulting works will be the property of the Insular Council, which will assume their subsequent maintenance, while the City Council will handle the expropriations and land transfers. The city council must publicize the insular contribution on posters, plaques, and press releases, and the agreement will also be published on the Council’s Transparency Portal.
The signature unlocks a pending action in a consolidated population center and transfers the management of the work to the administration closest to the territory, which should allow for greater agility in processing. For the residents of Can Marçà, the action translates into greater road safety, accessible itineraries, and new bus stops.
