Santa Ana puts its municipal commercial premises up for lease

The Santa Ana City Council has opened the public tender for the lease of the municipally-owned commercial premises located at Avenida de España, s/n, intended for the operation of a retail trade establishment for the supply of the population. The Mayor’s Office-Presidency approved the specific administrative clauses through a resolution dated September 18, 2026, and the tender announcement is published in the Official Gazette of the Province of Cáceres number 0183, dated September 24, 2026, Section I - Local Administration (official reference: BOP-2026-4441). Interested parties have 15 calendar days, counting from the day following the publication, to submit their proposals.
A patrimonial asset with mandatory commercial purpose
The property, with cadastral reference 2357126TJ4525N0001YE, has the legal classification of a patrimonial asset as it is not assigned to any municipal public use or service. The contract is classified as private in accordance with Article 9.2 of Law 9/2017, of November 8, on Public Sector Contracts, and is therefore excluded from the scope of said regulation.
The legal framework is completed, in order of precedence, by Law 7/1985, of April 2, Regulating the Bases of the Local Regime; the consolidated text approved by Royal Legislative Decree 781/1986, of April 18; the Regulation of Assets of Local Entities (Royal Decree 1372/1986, of June 13); and, subsidiarily, Law 33/2003, on the Heritage of Public Administrations. The preparation and award are administrative in nature, while its effects and termination are governed by private law.
The purpose is exclusive: the operation of a retail business that guarantees the supply of basic necessity products to the population of the municipality. The contracting body is the Mayor’s Office-Presidency, assisted by the municipal Secretariat-Intervention.
Rent, duration, and guarantees
- Minimum annual rent: 2,400.00 euros, which may be increased by the bidders.
- Payment: quarterly installments of 600.00 euros, within the first ten calendar days of each quarter.
- Duration: four years from formalization, extendable for two more annual periods by express agreement with at least three months’ notice.
- Provisional guarantee: not required.
- Definitive guarantee: 5% of the total amount of the contract for the initial duration, equivalent to 480.00 euros.
Proposals shall be submitted to the General Registry of the City Council (Plaza de España, 1, 10189, Santa Ana, Cáceres) or through the means provided for in the common administrative procedure legislation, in two sealed envelopes: Envelope A containing the administrative documentation and Envelope B containing the technical, economic, and schedule offer. Offers lower than the minimum rent or submitted after the deadline will not be accepted.
Evaluation criteria and contracting committee
Offers will be scored up to a maximum of 100 points: the offered economic rent provides up to 70 points, with the maximum score awarded to the highest proposal, and the opening hours up to 30 points, according to a closed scale based on the weekly extension over the required minimum.
- Extension of 9 hours: 30 points.
- Between 6 and less than 9 hours: 20 points.
- Between 3 and less than 6 hours: 10 points.
The Evaluation Committee will be constituted within five business days following the closing of the deadline and will be composed of Luis Enrique Rubio Jiménez, first deputy mayor, as president; Pilar Alvarado Fajardo, secretary-auditor, and Inés María Cercas Donaire, administrative assistant, as members; and Ángel Domínguez Pérez, secretary-auditor of the City Council of Robledillo de Trujillo, as secretary. The Mayor’s Office-Presidency will resolve within five days from the evaluation proposal.
Obligations of the successful bidder and deadlines
The lessee must keep the premises open to the public for a minimum of five hours daily from Monday to Saturday, permanently have basic necessity products available (milk, bread, eggs, sugar, and analogues), and supply fresh meat and fish at least two days per week. They will also assume the costs of utilities and taxes, may not sublet or assign the contract, and must preserve the furniture inventoried in Annex II.
The effective start of activity must occur within a maximum of 20 calendar days from formalization. Non-payment of two quarters, consecutive or not, or serious breach of the schedule or minimum assortment are grounds for termination, with loss of the final guarantee. If the tender remains vacant, the City Council may award directly due to limited demand in accordance with article 107.1 of Law 33/2003. An optional appeal for reversal may be filed against the specifications and the award within one month, or a contentious-administrative appeal within two months.
The operation seeks to guarantee a basic service in a small municipality, where the continuity of local commerce affects the daily lives of the residents. The minimum rent of 2,400 euros per year and the requirement for minimum hours and assortment set the conditions that the future lessee must meet.
