Sanlúcar la Mayor approves the expropriation of 2,748 meters to expand the cemetery

The Sanlúcar la Mayor City Council has definitively approved the compulsory expropriation project through a joint appraisal procedure for the area adjacent to the Municipal Cemetery, intended for its expansion. The resolution was adopted via Mayoral Decree No. 1085/2026, dated September 12, and is published in the Official Gazette of the Province of Seville number 185, corresponding to Wednesday, September 23, 2026, in the Local Administration section (official reference BOP-SE-2026-185012). The agreement involves the declaration of urgency for the occupation of the assets and sets a total fair price of 48,111.84 euros.
The file, processed under number 2026/ADQ_01/000001, complies with the expansion provision contained in the Partial Modification No. 5 of the PGOU, Partial Adaptation to the LOUA of the Subsidiary Norms SGEQ3 Municipal Cemetery, definitively approved on February 8, 2013, via Resolution of March 22, 2013 (BOJA No. 62, of April 2, 2013). That urban planning approval entailed the declaration of public utility of the land, a requirement that is now materialized through the expropriation.
The land and its valuation
The property subject to expropriation is identified with the following data:
- Address: polygon 30, plot 12, Las Tizas area.
- Registry reference: property No. 6902 of the Property Registry No. 1 of Sanlúcar la Mayor (entry 1, of February 21, 2012; folio 153, book 153, volume 1277).
- Cadastral reference: 41087A030000120000FT.
- Acquisition area: 2,748.50 square meters of land.
The approved expenditure to finance the operation is broken down as follows:
- Total fair price amount: 48,111.84 euros.
- Affection bonus: 2,331.79 euros.
- Annuity: 2026 fiscal year.
- Budgetary application: 0600/164/610/26000015.
Dismissed allegations and price adjustment
The decree resolves the three allegations submitted by the interested parties, all of which were dismissed according to the report from the Technical Services dated August 25, 2026:
- Document received on May 6, 2026, with entry registry No. 4174.
- Document received on July 10, 2026, with entry registry No. 6182.
- Document received on July 20, 2026, with entry registry No. 6365.
However, as a result of the second allegation, the City Council recognizes an increase of 1,476.00 euros as compensation for lost profits from the lease in effect until its termination. Furthermore, the calculation of the legal period to resolve and notify is declared resumed as of July 10, 2026, the date on which the request for documentation regarding the existence of tenants on the property was completed.
Deadlines, bonus, and occupation
The holders of assets and rights included in the file have a period of twenty business days from the notification to express in writing their reasoned disagreement with the approved valuation. If they do not file an opposition within that period, the valuations will be deemed accepted and the fair price will be definitively determined. If they accept them, they will be entitled to recognition and payment increased by ten percent as a settlement bonus, amounting to 4,663.58 euros.
In case of disagreement, the file and the contested appraisal sheets will be referred to the Provincial Valuation Commission of Andalusia to determine the fair price, with the amount being deposited with the competent General Deposit Fund. Once the amount has been deposited or paid, the City Council will proceed with the occupation of the affected assets. The agreement is published in the Official Gazette of the Province of Seville, on the notice board of the municipal electronic headquarters, and in the Transparency Portal, and appears signed by the mayor-president, Raúl Castilla Gutiérrez.
The final approval clears the last administrative step prior to the occupation of the land and opens the way for the municipal cemetery to gain land to meet the future demand for burial plots. For the affected owners and tenants, the calendar is now decisive: they have twenty business days to accept the valuation —with the ten percent bonus— or to challenge it before the Provincial Valuation Commission.
