Sangarrén definitively approves the ordinance for the cleaning and fencing of vacant lots
Por FactBox Admin

The City Council of Sangarrén has finalized the Ordinance regulating the cleaning and fencing of plots, after no claims were filed during the public exhibition period. The full text is published in the Official Gazette of the Province of Huesca number 206, dated Tuesday, October 27, 2026, with the official reference BOPH-2026-206016. The regulation requires all owners of urban land in the municipality to keep their plots clean and enclosed, and opens the door to sanctions and the execution of works by the Council at the owner’s expense.
From the plenary agreement to official publication
The initial approval agreement of the plenary was automatically finalized as no allegations were presented during the public exhibition process, according to the announcement signed in Sangarrén on October 21, 2026, by the mayor, Lucía Pérez Corvinos, and processed by the municipal Secretariat, with announcement number 4763.
The finalization is supported by article 70.2 of Law 7/1985, of April 2, on the Bases of the Local Regime, and article 141 of Law 7/1999, of April 9, on the Local Administration of Aragon. The ordinance is issued under the powers of article 254 of the Recast Text of the Urban Planning Law of Aragon, approved by Legislative Decree 1/2014, of July 8, and article 10 of the Urban Discipline Regulations, approved by Royal Decree 2187/1978, of June 23.
The scope of application is the urban center of the municipality, and all plots are subject to it, understood as urban land surfaces suitable for immediate use that are urbanized, have marked alignments and gradients, and do not need to yield land for roads. Due to its sanitary, security, and technical nature, the regulation is configured as an “Urban Police” ordinance, with its own standing independent of urban planning.
Permanent cleaning and prohibition of waste disposal
The text, structured into four chapters and 21 articles, assigns the mayor the direction of urban, rural, and sanitary police and the inspection of plots, works, and installations. Plots must be permanently clean, without waste or spontaneous vegetation that could harbor animals or plants that transmit diseases, generate bad odors, or cause fires, and wells must be covered to prevent accidents.
It is strictly forbidden to dump garbage, rubble, furniture, waste materials, and refuse of any kind on the plots. Anyone who does so will be sanctioned by the Mayor’s Office in accordance with Chapter IV, without prejudice to the actions that owners may exercise against the offenders. Cleaning tasks must only be communicated in advance to the Mayor’s Office-Presidency.
Two-meter fencing and municipal license
The obligation to fence is established independently of the protection fences required during new construction or demolition works. For a plot to be considered fenced, the enclosure must meet these conditions:
- Extend along the entire facade line according to the fixed alignment.
- Be constructed with brick or block masonry, single-twist metal mesh with embedded posts, or folded metal sheeting.
- Reach a minimum height of two meters; in the case of single-twist mesh, with vegetal screening or shading mesh to obscure the interior view.
- Have an access gate of sufficient dimensions for cleaning and waste removal.
On non-developable land, metal or vegetal enclosures of the type used in the region may be authorized, subject to request and municipal assessment, also at two meters measured from the ground level. The owner is obliged to replace deteriorated fencing and to request a municipal license, which will be processed as minor works.
Requirement, sanction, and forced execution
The procedure may be initiated ex officio or at the request of any interested party. Once the file has been opened and reported by the technical services, the Mayor’s Office requires the owner via decree, establishing the requirements and a timeframe proportional to the ordered action; the execution order is equivalent to a license and is exempt from fees and taxes. If the requirement is not met, a sanctioning proceeding for an urban planning infringement is opened, and the City Council may resort to the forced execution provided for in Article 259 of the Recast Text of the Urban Planning Law of Aragon and in Article 102 of Law 39/2015, of October 1.
Forced execution follows these steps:
- Budget for the works formulated by the municipal technical services.
- Notification to the interested party with a ten-day hearing for allegations.
- Resolution from the Mayor’s Office ordering subsidiary execution, awarded directly and charged to the municipal budget.
- Request, where applicable, for the judicial authorization of Article 87.2 of the Organic Law of the Judiciary.
Entry into force and appeal
The ordinance shall enter into force once its full text has been published in the Official Gazette of the Province and the period set forth in Article 65.2 of Law 7/1985 has elapsed, remaining in effect until its express modification or repeal. An administrative appeal may be filed against the agreement before the Contentious-Administrative Chamber of the High Court of Justice of Aragon, based in Zaragoza, within two months from the day following publication, according to Article 46 of Law 29/1998, of July 13.
The regulation affects all urban land owners in the municipality, who from now on assume an active conservation obligation: keeping the plot clean, enclosing it with a regulatory fence, and paying for the work if the City Council must replace them. The two-month window to appeal makes this publication the starting point for a tangible change in the management of urban land in Sangarrén.
