San Miguel de Salinas approves the street vending ordinance

The San Miguel de Salinas City Council has finalized the Ordinance regulating non-sedentary sales, the full text of which is published in the Official Gazette of the Province of Alicante (BOP) No. 183, dated September 25, 2026, under official reference 7174. The regulation comes into force upon the publication of its text in the Provincial Gazette and replaces the ordinance approved in 2013. The new regime organizes street market authorizations and penalizes non-compliance with fines ranging from 150 to 3,000 euros.

The Plenary of the City Council, in an ordinary session held on July 30, 2026, agreed to the initial approval of the ordinance. The provisional agreement was published in BOP No. 148, dated August 7, 2026, and, after the public exhibition period elapsed without any claims being filed, it was finalized in accordance with Article 49 of Law 7/1985, of April 2, regulating the Bases of the Local Regime. The full publication is carried out in compliance with Article 70.2 of the same law.

The ordinance is issued under the framework of Law 3/2011, of March 23, on Trade of the Comunitat Valenciana, and Decree 65/2012, of April 20, of the Consell, which regulates non-sedentary sales in the Comunitat Valenciana, within the framework of Directive 2006/123/EC and Royal Decree 199/2010, of February 26.

Authorizations of up to fifteen years

The exercise of the activity is subject to prior municipal authorization, granted by the Mayor’s Office or the Local Government Board, and the stall may not be occupied without having made the advance payment for the month. The validity periods are:

• Periodic street markets: 15 years.
• Occasional street markets: at most, the period of the event to which they are linked.
• Isolated sales in a fixed location or itinerant sales: maximum of 4 years.

Authorizations for periodic street markets and isolated or itinerant sales are renewable upon request by the holder for the same period. No natural or legal person may hold more than one stall in the same market and period, and the exercise of sales without authorization is prohibited. The award is resolved through a competitive process using a 24-point scale, which evaluates professional experience (up to 12 points) and specific training (up to 6). Additionally, the Municipal Registry of Non-Sedentary Sales Traders is created, which is public in nature, and the establishment of a Local Council for Non-Sedentary Trade is foreseen, whose opinions shall not be binding.

The Wednesday street market

Annex I of the ordinance sets the conditions for the municipality’s permanent public street market. It is held on Wednesdays on a weekly basis, from 07:00 to 14:00 hours, with a deadline for access at 08:00 and without the activity being able to start before 07:00. The location streets are:

• John XXIII.
• El Calvario.
• Avenida del Prado.
• Pablo Neruda.
• Federico García Lorca.

The authorized offer includes textiles and clothing, footwear, bags and leather goods, costume jewelry and accessories, perfumery, household goods, hardware, cleaning and drugstore products, earthenware and porcelain, plants and flowers, trinkets, crafts and ornaments, and other non-perishable products of a similar nature. The sale of meats and offal, fresh sausages, fresh or frozen fish and shellfish, fresh and pasteurized milk, fresh cheeses and other fresh dairy derivatives, bulk liquids, eggs, and live animals is prohibited.

Fines of up to 3,000 euros

The sanctioning regime classifies infractions as minor, serious, and very serious, with the following amounts:

• Minor: warning or fine from 150 to 750 euros.
• Serious: fine from 750.01 to 1,500 euros.
• Very serious: fine from 1,500.01 to 3,000 euros.

Very serious infractions include the installation of the stall without authorization, physical or verbal aggression against vendors, the public, officials, and authorities, willful damage to stalls or facilities, and the unauthorized leasing, subleasing, or transfer of the stall. In serious and very serious cases, the revocation of the authorization and the seizure of merchandise, stalls, facilities, and vehicles may also be agreed upon as an accessory measure. The admission of responsibility and the advance payment of the sanction each reduce the fine by 20%, up to a cumulative maximum of 40%. Minor infractions expire after six months, serious ones after two years, and very serious ones after three.

The ordinance expressly repeals the non-sedentary sales regulation approved by the Plenary Council on March 28, 2013. An administrative appeal may be filed against the final approval agreement before the Administrative Chamber of the High Court of Justice of the Valencian Community within two months from the day following the publication of the announcement.
