Ruanes declares the imminent ruin of a dwelling and orders its demolition
Por FactBox Admin

The Ruanes City Council has declared the imminent physical ruin of the building located at 14 Ronda San Gregorio Street (formerly 16 Queipo de Llano Street), and has required its owners to demolish the remains and clear the debris from the plot. The resolution, signed by the mayor-president José Rodríguez Picado, is published in the Official Gazette of the Province of Cáceres on October 22, 2026 (CVE: BOP-2026-4977), due to the serious and imminent danger of collapse and the falling of elements onto the public road and adjacent properties.
The decision is adopted under articles 167, 169, and 170 of Law 11/2018, of December 21, on sustainable territorial and urban planning of Extremadura (LOTUS), and articles 209 and 210 of the General Regulations of the LOTUS, approved by Decree 143/2021, of December 21. The mayor acts with the powers conferred by article 21.1 of Law 7/1985, of April 2, regulating the Bases of the Local Regime.
The case is based on a technical report that certifies the state of the property, with cadastral reference 0376307TJ4507N0001TY, and the resulting risk to public safety. The publication in the BOP and in the Single Edict Board of the Official State Gazette (TEU-BOE) is justified because the identity and address of the property owners are unknown, in accordance with articles 44 and 45 of Law 39/2015, of October 1, on the Common Administrative Procedure.
Collapse of roofs and economic ruin
The technical report certifies the total collapse of roofs, floor slabs, and vaults, the lack of structural stability, and the imminent risk of collapse of the remaining enclosures and masonry and rammed earth walls onto the public road. To this is added a large accumulation of debris and weeds, with a risk of unsanitary conditions and fire.
Furthermore, the recovery of the property is considered economically unfeasible, as the cost of the works exceeds 50% of the replacement value of a new building with similar characteristics.
Precautionary measures and execution order
The City Council ratifies and agrees, with immediate effect, provisional security measures, which the municipal services will execute preventively and without prejudice to the subsequent charging of costs to the property:
- Signaling, delimitation, and fencing of the entire facade area facing the public road, both on the main and rear facades.
- Total demolition of the remaining enclosure walls and unstable elements that threaten to collapse.
- Removal of debris and materials accumulated inside, and cleaning of the plot.
- Fencing of the resulting plot or site, in accordance with municipal urban planning guidelines.
The works must have the mandatory direction and supervision of a competent technician and comply with obtaining the corresponding municipal authorization or enabling title within a maximum period of ten business days from the day following the publication of the announcement in the BOE. The resolution expressly warns the obligated parties of subsidiary execution in the event of non-compliance.
Deadlines, allegations, and appeals
- Allegations: ten business days, with consultation of the resolution and the file at the Ruanes City Council, Plaza de España, 1, 10272 Ruanes (Cáceres).
- Optional appeal for reversal before the Mayor’s Office-Presidency: one month from the day following publication, according to articles 123 and 124 of Law 39/2015.
- Contentious-administrative appeal before the Contentious-Administrative Court of Cáceres: two months, in accordance with Law 29/1998, of July 13.
The resolution ends the administrative route by virtue of article 52 of Law 7/1985, without prejudice to any other appeal that the interested parties deem appropriate.
The declaration directly affects the safety of the residents and adjacent properties of a small municipality, where a building in a state of collapse next to the public road multiplies the risk of collapses. The announcement also establishes a strict framework of responsibility for a property whose owners could not be located, such that the City Council may act subsidiarily and pass on the costs if the demolition is not executed within the deadline.
