Publicada la modificación del PGOU de Casares sobre el suelo no urbanizable

The Territorial Delegation of Housing, Youth, Territorial Planning, and Development and Mobility in Málaga has arranged for the publication of the resolution ordering the registration and publication of the “Modification of the PGOU of Casares regarding the urban planning regulations for non-developable land.” The agreement is formalized through the Resolution of October 14, 2026, which gives effect to the Resolution of September 23, 2026, and appears published in the Official Gazette of the Junta de Andalucía (BOJA) No. 204, of October 21, 2026, under text No. 13720 with a length of 78 pages.

Two resolutions and a single file

The publication is the result of an administrative chain of two linked acts, both from the same territorial body with competencies in territorial planning in the province of Málaga:

  • Resolution of September 23, 2026: orders the registration and publication of the modification of the general planning of Casares.
  • Resolution of October 14, 2026: stipulates that this mandate be materialized through its insertion in the official gazette.
  • Text No. 13720, inserted in Section 3. Other provisions of BOJA No. 204, of October 21, 2026.
  • Length of the published document: 78 pages.

Registration and publication constitute the final steps of the procedure for modifying a general planning instrument, once the text has been approved. With these, the document ceases to be an administrative file in process and becomes part of the urban planning regulations applicable within the municipal boundary.

The object: regulations for non-developable land

According to the official statement, the modification is limited to the urban planning regulations for non-developable land of the General Urban Development Plan (PGOU) of Casares. In other words, the declared object is the regulatory body of the plan—the normative determinations that dictate what can be done and how on that type of land—and not a reclassification operation or a reorganization of the municipality’s territorial model.

Non-developable land is the category that general planning reserves for land excluded from the urbanization process, subject to a restrictive regime of uses and buildings. Any change in its regulations directly affects municipal practice: it determines which activities can be authorized, under what conditions of plot, volume, or implementation, and under which circumstances an urban planning license is or is not appropriate.

Effects for owners, developers, and the City Council

Insertion into the BOJA is not a minor formal procedure: it is the act that provides official publicity to the new text and makes it enforceable against third parties. From the moment of that publication, the Casares City Council must apply the modified regulations in the instruction and resolution of licenses and in the processing of municipal action declarations on non-developable land.

For landowners and developers with initiatives within the municipal district, the change necessitates a review of projects and prior consultations in light of the now-published text, as the applicable regulation is no longer the one previously in force. The full publication of the document—78 pages—further allows direct access to the regulatory content, without the need to consult the administrative file.

A municipality with general planning under regulatory revision

Casares, in the province of Málaga, has a PGOU (General Urban Planning Plan) that organizes the entirety of its municipal district, and one of its most sensitive parts—that relating to non-developable land—is now being updated. The modification does not alter the land classification according to the official title, but it does change the regulatory framework that conditions the day-to-day building activity and the permitted uses in the municipality.

The news has a direct impact on anyone interested in acting on non-developable land in Casares: owners intending to carry out works or changes of use, professionals drafting projects, and the council itself, which must adjust its reports and resolutions to the text recently published in the official bulletin.
