PROCESA incorpora el Plan LGTBI y ajusta la titulación del Grupo 3

The Government Delegation in Ceuta, through the Labor and Immigration Area, has ordered the registration in the Registry of Collective Agreements and Accords and the publication of the modification of Article 17 and the inclusion of the LGTBI Plan in the collective agreement of the Public Company for the Encouragement and Promotion of the Socio-Economic Development of Ceuta S.A. (PROCESA). The resolution, signed on October 19, 2026, by the Government Delegate José D. de la Encina Ortega, is published in the Official Gazette of the City of Ceuta (BOCCE) number 6,663, dated October 23, 2026, within the General Provisions section, under announcement number 705 and file reference 51/01/0018/2026.

The text subject to registration was signed on April 27, 2026, at the PROCESA facilities by the company representation and the workers’ representation, and is processed in accordance with Article 90, paragraphs 2 and 3, of Royal Legislative Decree 2/2015, of March 24, which approves the revised text of the Workers’ Statute Law, and Article 2 of Royal Decree 713/2010, of May 28, on the Registration and Deposit of Collective Agreements.

The resolution consists of two mandates: to order the registration in the electronic registry of the governing center, with notification to the negotiating commission, and to arrange for publication in the Official Gazette of the City. The agreement also includes an express warning to the negotiating commission regarding the mandatory compliance with higher-ranking regulations in the execution of the agreement. The act is also signed by the general secretary, Ismael Kasrou Contioso, acting by substitution under Article 72 of Law 40/2015.

New wording of Article 17

The first point of the agreement modifies the qualification required for Professional Group 3. The wording in effect until now was “Baccalaureate, Intermediate Vocational Training Cycle, Higher Vocational Training Cycle or equivalent,” a formula that, according to the minutes, mixed heterogeneous training levels and could generate inconsistencies in professional classification.

The new wording is as follows:

  • Required qualification: “Baccalaureate, Higher Vocational Training Cycle or equivalent”.
  • Therefore, the Intermediate Vocational Training Cycle is excluded from the access range for the group.
  • The agreement was adopted by 3 votes in favor and 2 abstentions.

Mandatory LGTBI Plan

The second point incorporates an LGTBI Plan into the agreement, which the minutes describe as mandatory for companies with more than 50 workers and which establishes measures to guarantee equality and non-discrimination of LGTBI people in the work environment. This point was approved by 5 votes in favor, with no abstentions or votes against recorded.

The session of April 27, 2026, which began at 12:00 hours, had the following representation:

  • For the company, the director José Diestro Gómez.
  • For Comisiones Obreras de Ceuta: Salua Mohamed Amar, president of the commission; María Teresa Pérez Muñoz and Morad Mohamed Ahmed, secretary.
  • For the Unión General de Trabajadores de Ceuta: Isabel Cabrera Sánchez and Dulce María Espinosa Martín.

Impact on the workforce

The agreement affects all personnel of the public company, both through professional classification and the incorporation of an equality and non-discrimination framework. The modification of Article 17 tightens the minimum training level for Professional Group 3, while the LGBTI Plan introduces internal action obligations for an entity that exceeds the threshold of 50 workers that triggers this requirement. With the registration and publication ordered by the Government Delegation in Ceuta, the text acquires registration efficacy and is formally incorporated into the PROCESA collective agreement, such that any future call or internal promotion within the company must now comply with the new qualification.
