Posadas definitively approves the modification of the PGOU in La Estación

The Plenary of the Posadas City Council definitively approved on July 30, 2026, the Specific Modification of the General Urban Development Plan (PGOU) which eliminates the Isolated Action AA-3 “La Estación” and reclassifies that area as a Closed Block. The agreement is published in the Official Gazette of the Province of Córdoba number 199, dated October 14, 2026, with the reference BOP-A-2026-3358 (pages 14867 and 14868). The innovation enters into force the day following its publication in the provincial gazette.

The modification is non-structural in nature, is promoted by the Posadas City Council itself, and was drafted by the municipal architect Miguel Ángel Sierra Lebrón. The agreement is adopted under Article 83 of Law 7/2021, of December 1, for the promotion of the sustainability of the territory of Andalusia (LISTA), which requires the publication in the provincial gazette of the definitive approval agreement of urban planning instruments along with the articles of the urban regulations.

Prior to publication, the instrument was registered and deposited in the Municipal Administrative Registry of Planning Instruments, with Registry Number 24, and in the Regional Registry of Urban Instruments, with Registry Number 11,027, in the Planning Instruments Section of the Posadas Registry Book of the Córdoba Registry Unit. The Territorial Delegation in Córdoba of the Ministry of Development, Territorial Articulation and Housing issued the registry certification on September 21, 2026.

Suppression of file AA-3 and effects on the land

The sole article of the modification removes from the Urban Regulations of the PGOU the planning file corresponding to the Isolated Action AA-3 “La Estación”. As a consequence, the PGOU determinations linked to said action in that area are rendered null and void, and in particular:

• Its acquisition through expropriation.
• Its designation as a road or road system.
• The planning objectives associated with the demolition of existing buildings and the acquisition of the open space or road provided for in the file.

The area affected by the extinction of the isolated action is subject to the urban planning determinations contained in this Specific Modification, both in its written and graphic documentation. The innovation replaces, where incompatible, the determinations of the current PGOU relating to file AA-3 “La Estación”.

Regional registry, one-month period and entry into force

The agreement of the Plenary establishes several administrative obligations:

• Submit the complete innovation document, with secure verification code (CSV) C40E 3D49 68CE EFEA F639, to the Territorial Delegation in Córdoba within a maximum period of one month from the final approval.
• Carry out the deposit and registration in the Autonomous Registry of Planning Instruments, in accordance with article 82.1 of the LISTA, Decree 550/2022, of November 29, which approves the General Regulations of the LISTA, and Decree 2/2004, of January 7.
• Publish the agreement along with the articles of the urban planning regulations in the Official Gazette of the province.

The entry into force of the urban planning instrument and the effects thereof pursuant to article 84 of the Law shall occur from the day following its publication in the Official Gazette of the province.

Allegations and contentious-administrative appeal

The announcement is published for general knowledge and specifies that a contentious-administrative appeal may be filed against this agreement before the Contentious-Administrative Chamber of the High Court of Justice of Andalusia, based in Seville, within a period of two months starting from the day following the publication of the final approval agreement, pursuant to articles 10 and 46 of Law 29/1998, of July 13. The announcement was signed in Posadas on October 1, 2026, by the mayor, Emilio Martínez Pedrera.

The rezoning of La Estación as a closed block changes the urban planning regime of the area: the provision for expropriation and the opening of roads disappears, and the land is to be organized according to the determinations of the modification, which conditions the uses and future buildability of the area and directly affects the owners of the included plots.
