Ports de les Illes Balears suspends the Cala'n Bosch tender

Ports de les Illes Balears has declared the suspension of the tender for the granting of the administrative concession for the occupation and operation of the Cala’n Bosch Marina-Menorca, in the municipality of Ciutadella. The measure, effective from September 6, 2026, is published in the Official Gazette of the Balearic Islands (BOIB) no. 121, of September 26, 2026, section III, edict 9621, and comes after the appeal for reversal filed by Holiday Lines Menorca, S.L.

A tender halted by administrative silence

The procedure has been suspended because more than one month passed since the filing of the appeal without the competent body issuing or notifying an express resolution regarding the requested suspension. Article 117 of Law 39/2015 establishes that, in this case, the execution of the challenged act is understood to be suspended.

The resolution, signed in Palma on September 24, 2026, orders the notification of the decision to the interested party and its publication on the Public Sector Procurement Platform (PLACE), in the BOIB, and on the PortsIB website.

Background of the procedure

06/30/2026: The Agreement of the Board of Directors of Ports de les Illes Balears initiates the file and approves the call, the specifications, and the economic-financial viability study of the tender.
07/07/2026: The agreement is published in the BOIB.
07/09/2026: It is published on PLACE.
08/05/2026: The appeal for reversal from Alan Cesar Pons Hampshire, representing Holiday Lines Menorca, S.L., against the agreement approving the bases, with a request for suspension, enters the PortsIB electronic registry.
09/06/2026: Effective date of the declared suspension.

Legal basis of the decision

Competence over the public port domain of ports not declared of general interest corresponds to the Autonomous Community, according to article 30.5 of the Statute of Autonomy (LO 2/1983, reformed by LO 1/2007) and article 3 of Law 10/2005, on the ports of the Balearic Islands. Article 26.2 attributes executive powers over these ports to PortsIB.

The same Law 10/2005 subjects any occupation of the public port domain with non-removable works or installations or with uses exceeding four years to administrative concession (article 72) and empowers PortsIB to call tenders through publication in the BOIB (article 79). The resolution is adopted under article 10k) of the Statutes of Ports de les Illes Balears (Decree 134/2005), which allows the vice president to adopt urgent decisions and measures.

Deadlines and appeals

Against the resolution, which does not exhaust the administrative route, an appeal for reversal may be filed before the Board of Directors within a period of one month counting from the day after notification, in accordance with article 122 of Law 39/2015 and article 58 of Law 3/2003.

The resolution is reported by the head of the Legal and Administrative Department, Antonio Armengol Garau, and resolved by the vice president, Antonio Mercant Morato.

The suspension of the tender leaves the bidding for a nautical infrastructure relevant to Menorca up in the air and affects both the investors interested in the operation of the port and the users and nautical companies of Ciutadella, who will have to wait for the resolution of the appeal to know the future of the procedure.
