Ponferrada mandates building inspections at 40 years
Por FactBox Admin

The Plenary of the Ponferrada City Council has definitively approved the Regulatory Ordinance for the Technical Inspection of Buildings, the full text of which is published in the Official Gazette of the Province of León number 204, dated Tuesday, October 27, 2026, with the official reference BOP-LE-2026-204007. The regulation mandates the inspection of all buildings in the municipality at 40 years of age and every ten years thereafter, and it enters into force the month following its publication, that is, at the end of November 2026.
The ordinance culminates a process initiated in the plenary session of May 29, 2026, when the text was initially approved and submitted for public consultation. As no objections were presented during the exhibition phase, the provisional approval was elevated to definitive, and the full text is published in accordance with Article 70.2 of Law 7/1985, of April 2, regulating the Bases of the Local Regime.
The framework of the regulation is the duty of conservation established by Law 5/1999, of April 8, on Urbanism of Castilla y León and by Decree 22/2004, of January 29, which approves the Urbanism Regulations of Castilla y León, where technical inspection is mandatory in municipalities of 20,000 inhabitants or more. The ordinance also seeks for the inspection to have the effects of the building evaluation report provided for in Law 7/2015 on Land and Urban Rehabilitation.
Forty years and reviews every decade
Article 4 establishes the deadlines: all buildings must undergo a first inspection within the calendar year following that in which they reach forty years from their completion or from a comprehensive or total rehabilitation. Subsequently, there will be a second inspection and successive ones within the calendar year following that in which ten years have passed since the previous one.
The obligated parties are the owners; under a horizontal property regime, the community of owners is responsible, which must commission the inspection of the entire building and facilitate access. The report includes energy certification and accessibility evaluation, and must cover at least 50% of the built surface.
The City Council will prepare a census of buildings subject to inspection, displayed to the public for 30 days within the year prior to the deadline, with announcements in the provincial gazette, the municipal notice board, the website, and a provincial circulation newspaper. This exhibition shall be considered notification to the interested parties.
Transitional calendar until 2037
For buildings that already exceed 40 years, the fourth additional provision establishes a staggered application:
- Buildings constructed up to 1899: during 2027.
- Constructed in 1900: during 2028.
- From 1901 to 1942: during 2029.
- From 1943 to 1955: during 2030.
- From 1956 to 1961: during 2031.
- From 1962 to 1968: during 2032.
- From 1969 to 1973: during 2033.
- From 1974 to 1981: during 2034.
- From 1982 to 1990: during 2035.
- From 1991 to 1996: during 2036.
- From 2037 onwards: all those that reach 40 years of age or whose last inspection exceeds ten years.
The transitional provision maintains the effectiveness of files already resolved and registered up to ten years after their completion.
Sanctions, subsidiary execution, and blocking of licenses
Title II, regarding the sanctioning regime, refers to regional regulations and establishes in Article 13 fines between 1,000.00 and 10,000.00 euros, in accordance with Article 352.1.c) of the RUCyL. The sanction will be increased if the sum of the cost of the inspection and the works exceeds the maximum provided, to avoid any economic benefit for the offender.
Article 9 empowers the City Council of Ponferrada to issue execution orders and, in case of non-compliance, agree on subsidiary execution or impose coercive fines up to the limit of the maintenance duty, following a warning, according to Article 322 of the RUCyL. If the owner does not prove the inspection, they may be required to do so within a maximum period of three months, after which it will be carried out ex officio at their expense.
Article 8.7 closes the administrative route for those in arrears with the ITE: municipal authorization for works in obligated buildings lacking an inspection will not be granted, except for minor works of low significance in the interiors of homes and premises.
Public registry and promotion measures
The ordinance provides for a computerized and public Municipal ITE Registry for those who prove a legitimate interest in purchase or lease, with data transferred to the regional registry RegiteCyL. Official forms are generated using the ITE|IEE Castilla y León application, from the Construction Institute of Castilla y León (ICCL).
As a counterbalance, the second additional provision allows for discounts on the Tax on Constructions, Installations and Works and preferential processing of licenses for safety works derived from the inspection.
The regulation turns building conservation into a verifiable and dated obligation in a municipality with an aging residential stock, especially in the old town. Owners of properties prior to 1899 have until the end of 2027 to present their first inspection, and those who do not will face sanctions, execution at their expense, and the suspension of any building licenses.
