Plasencia definitively approves the fee for occupying public roads

The Plasencia City Council has finalized the modification of Fiscal Ordinance No. 13, which regulates the fee for the special occupation or use of public land. The agreement, initially approved by the Plenary in the session of May 15, 2026, is published in full in the Official Gazette of the Province of Cáceres No. 181, dated September 22, 2026 (CVE: BOP-2026-4394). The regulation sets the rates to be paid by kiosks, hospitality terraces, banners, fences, and other installations occupying public roads.

The file was subject to public information and hearing via an announcement on the municipal notice board and in the BOP of Cáceres No. 99, dated May 27, 2026, for a period of thirty days. As required by Article 17.2 of Royal Legislative Decree 2/2004, of March 5, which approves the revised text of the Law Regulating Local Treasuries (TRLHL), the public exhibition edict was also published in the Periódico de Extremadura on September 14, 2026. Since no claims were filed, the provisional agreement is made final without the need for a new plenary agreement, in accordance with Article 17.3 of the TRLHL.

The edict was signed in Plasencia on September 15, 2026, by the mayor, David Casimiro Dóniga Estévez.

Kiosks: rates by season and surface area

The First Rate details the annual or summer season amounts according to the type of kiosk and the category of the street:

• Sale of ice cream in first-category streets or areas: 315.55 euros per summer season; in other streets, 239.70 euros.
• Sale of sweets in first and second-category streets: 303.15 euros per year up to 5 m², plus 31.90 euros for every additional 2 m².
• Sale of newspapers and magazines: 349.60 euros per year up to 5 m² in first and second category, and 232.10 euros in other streets.
• Newspaper and magazine kiosk in the Plaza Mayor: 653.35 euros per year.
• Beverage kiosk at the entrance of the Parque de los Pinos: 797.80 euros per year.
• Beverage kiosks in the Parque de la Coronación: 399.50 euros up to 150 m² and 797.80 euros above that surface area.
• Refreshing beverage kiosks on the banks of the Jerte River: 188.60 euros per summer season.
• O.N.C.E. kiosks: 203.30 euros per year.

Terraces: tables, chairs, and surcharges

The Second Rate taxes the use of tables, chairs, awnings, and elements that delimit the terrace, using each table with four chairs per year as the base:

• In the Plaza Mayor: 99.90 euros.
• Within the walled enclosure and in the Parque de la Coronación: 39.95 euros.
• Outside the walled enclosure: 20.55 euros.

Compatible surcharges are applied to those amounts: 20 percent when light constructions such as glass or methacrylate panels are installed, 15 percent for hedges, potted plants, or trellises, and 20 percent for decking or other ground coverings.

Advertising, works, and other occupations

The Third Tariff sets 417.60 euros per year per billboard, 69.60 euros for fixed information signs, 34.80 euros for protective fences and other urban furniture, and 0.65 euros per day for banners and temporary advertising supports. The City Council may establish agreements with advertising companies.

The text also regulates other occupations:

• Works: 14.05 euros per square meter per month for fencing of barriers, materials, or rubble, and 6.95 euros for caution fences, scaffolding, or frameworks.
• Subsoil: 1.25 euros per linear meter of private piping per year.
• Total street closure: 90 euros per day on first-category streets and 50 euros on the rest; partial closure is charged at 50 percent.
• ATMs: 763.00 euros on special category streets and 586.92 euros on the rest.
• Elevators: 43.80 euros per square meter per year.
• Tuesday and Friday market: 0.2375 euros per m² per day for food stalls from producers and 0.4625 euros for the rest.

Management, deadlines, and background

No occupation may be carried out without prior authorization and without having paid the fee. Annual or seasonal uses will be managed via registry or license and paid by bank direct debit; those shorter than a year will be settled via self-assessment at the Municipal Treasury or collaborating entities. Deferment or installment payments will not be permitted for occupations shorter than one month.

The agreement exhausts the administrative route, therefore it may be challenged through a contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of Extremadura within two months from the day following its publication in the BOP. The original ordinance was approved by the Plenary on October 26, 2007, effective from January 1, 2008, and its current wording stems from the plenary agreement of April 5, 2024, published in BOP No. 105, dated June 4, 2024.

The update directly affects hoteliers, merchants, and kiosk owners in Plasencia, who already know the exact amounts they must pay for occupying municipal sidewalks, squares, and parks. Since the administrative route has been exhausted, the window to appeal the regulation is limited to two months before the contentious-administrative courts.
