Palau-solità approves the civility ordinance with sanctions from 50 to 3,000 euros

The Plenary of the Palau-solità i Plegamans City Council has definitively approved the Municipal Ordinance on Civility and Coexistence, which comes into force following its full publication in the Official Gazette of the Province of Barcelona on September 21, 2026. The text, consisting of 140 pages and referenced as CVE 202610141477, establishes a sanctioning regime of between 50 and 3,000 euros and replaces the civility ordinance in effect since 2009.
The initial approval took place at the Plenary on April 30, 2026. Once the public exhibition was completed and the allegations resolved, the Plenary on July 30, 2026, definitively approved the regulation, which is published in accordance with article 70.2 of Law 7/1985, of April 2, regulating the bases of the local regime. The announcement was signed by the acting mayor Eva Soler Guallar, dated September 16, 2026.
The ordinance is structured into four titles and 126 articles, plus three annexes: the sanctions table, the usage regulations for citizens of the Hostal del Fum park, and the regulation of the Coexistence Board and alternative measures to administrative sanctions.
Sanctions from 50 to 3,000 euros
The general sanctions regime, set out in article 113, establishes three tiers:
- Minor infractions: fine from 50 to 750 euros.
- Serious infractions: fine from 750.01 to 1,500 euros.
- Very serious infractions: fine from 1,500.01 to 3,000 euros.
Sanctions are applied in the absence of specific sectoral regulations and are compatible with the requirement to restore the altered situation, civil liability, and compensation for damages caused. Recidivism in less than one year is an aggravating circumstance, while voluntary and immediate repair of the damage is a mitigating one. Precautionary measures are provided for, such as the suspension or revocation of licenses, the closure of establishments, the temporary suspension of activity, and the sealing of emitting sources, as well as the seizure of equipment, goods, and money or products obtained through the infringing activity.
Typified behaviors and highlighted amounts
The text regulates behaviors against the dignity of persons, paintings and graffiti, advertising and propaganda installations, games and acrobatics in public spaces, gambling and betting, begging, the offer and demand of sexual services, sexist and LGTBIQ+phobic violence, consumption of alcohol and drugs, unauthorized street vending, urban hygiene and neighborhood relations, establishment hours, and pyrotechnics and bonfires. Some specific amounts:
- Paint and graffiti: from 50 to 750 euros if they are minor; from 750.01 to 1,500 if they affect facades, transport elements, or street furniture; up to 3,000 if they damage monuments or listed buildings.
- Consumption of alcoholic beverages in public spaces outside of authorized cases: minor offense, from 50 to 750 euros.
- Games and acrobatics with bicycles, skates, skateboards, or electric gadgets outside of designated areas: from 50 to 750 euros; dangerous games and the practice known as “rooftopping”, from 750.01 to 1,500.
- Offering gambling, betting, and games of chance to minors or vulnerable groups: very serious offense, up to 3,000 euros.
- Bonfires and pyrotechnic activities without authorization: from 50 to 750 euros; if they cause damage to property or people, up to 3,000.
Minors and alternative measures
Children under 12 are not considered responsible for offenses. Between the ages of 12 and 17, minor offenses may be replaced by educational and restorative measures from the MASE Program, with a request submitted within fifteen business days following the notification of the initiation of the proceedings. Fathers, mothers, or guardians are subsidiarily civilly liable and may be sanctioned with fines from 50 to 750 euros when the minor does not attend the educational center during school hours.
The Coexistence Board (Taula de Convivència) will be the space for citizen participation in these policies. Until it is formally established, a provisional commission designated by mayoral resolution, composed of at least one representative from the youth service, one from Social Action, and one from the Local Police, will assume its functions; the city council commits to launching it within a maximum period of one year.
Appeal and validity
The agreement ends the administrative route and may be challenged through a contentious-administrative appeal before the contentious-administrative Chamber of the High Court of Justice of Catalonia within two months starting from the day after publication. The announcement indicates that the ordinance enters into force the day after publication, once the period of article 65.2 of Law 7/1985 has elapsed; however, the final provision of the text sets the entry into force fifteen business days after full publication, a period during which a summary will be made known to the citizens, especially to neighborhood communities, businesses, and town entities.
The regulation repeals the Civility Ordinance approved by the Plenary on June 25, 2009, and published in the BOPB on November 17, 2009. With this text, Palau-solità i Plegamans has for the first time a complete and graded local sanctioning regime for uncivil behaviors in public spaces, which affects all citizens as well as establishments, entities, and event organizers.
